Probe clears 5 SWAT-raid officers

The five SWAT officers who shot and killed 26-year-old Jose Guerena while serving a search warrant May 5 have been cleared of any wrongdoing.

The Pima County Regional SWAT team members -from four law enforcement agencies in the county - were justified in using deadly force against Guerena, according to an investigation by the Pima County Attorney's Office.

A close examination of the AR-15 rifle Guerena was holding at the time he was shot revealed that the bullet damage was done at an angle that indicated Guerena was pointing it at the officers, Berkman wrote in the letter.

BTW: I'll save all the naysayers and cop-haters time, as this will basically sum up everything they will have to say:

I cannot possible convey to you how shocked I am that the Pima Co government would clear the Pima County government of wrongdoing.

Good thing it’s a nice evening here so that I can open my windows and let the stink out. What exactly was this man guilty of? What were they going to charge him with? What contraband did they find? If SWAT entered my home right now like that I’d soon be dead also because I’d be pointing right back at them. Thugs with credentials.

Of course he was pointing it at the “officers,” you nimrods, he didn’t know what bunch of yay-hoos was scaring his family and breaking down his door. This whole issue needs to go further up the justice ladder.

I only wish the Grand Jury in that county would use Presentments to force their trial: fir I know this, if while I was deployed to Iraq I had done to an innocent foreign citizen what the SWAT did to that marine I would surely have been prosecuted.

So that fifth cop blindly shooting over his fellow bravehearts was following procedure. Not surprising.

Not just shocked, but really shocked, but don't they say that about everybody?

Sure they dropped Jared like a hot potato after he assassinated that Republican judge, but that's a rare exception.

BTW, since we know this all started when one of the cops shot up a door hinge, no one really knows where the gun was pointed as they entered. Could they have forgotten that already?

As a retired police officer, this is one of the few times I would agree with the police haters ... someone kicking in my door without giving me time to assure myself as to who they were will meet my shotgun head on. Promise.

The one that should pay for this is the person that got the address/information wrong ... not that that will help the young widow or her deceased husband.

And let's talk about the 70+ shots these a-holes fired. Some of those shots hit neighboring homes. What if they had hit another person? Those shooting stats alone should get their status as “officers” pulled.

Wanting the truth is not being a cop hater and wanting the use of SWAT teams to be brought under control is not cop hating. You forgot the three monkeys for yourself. Speak, see and hear no evil if it involves a cop. Right.

What if the bullet strike on the AR happened after he went down and was not in control of where it was pointing?

If it was one of the first of the 70 shots, then maybe, but if it was the 50th I don’t know.
