Records: Guerena's brother was center of drug-trafficking probe

The older brother of the man shot and killed during a SWAT raid last month was the primary focus of a long-term drug-trafficking investigation, records released Thursday show.

Jose Guerena and an assortment of relatives and acquaintances are mentioned in a report that chronicles a probe that stretched over two years of a suspected drug-trafficking ring in which several people appeared to have no source of income - except for monthly welfare checks several people named in the reports received - to account for their expensive cars and properties, the records released under a court order indicate.

The Pima County Sheriff's Department investigation started with a traffic stop in early 2009.

The department released the affidavit, probable-cause statements and search-warrant returns after Pima County Superior Court Judge Deborah Bernini filed a ruling Thursday unsealing the documents. She allowed the department to censor eight lines that included information about an informant in the case.

They suspected his brother was dealing drugs, so it makes perfect sense to shoot the guy who wasn’t suspected of dealing drugs 20 some times.

Yep, that Sheriff Dipstick sure can run a department...

These people aren't criminals in Dupnik's eyes - they're his CONSTITUENTS.

Now, a guy working the night shift at a mine, making a pinata with his wife to save a few bucks for a birthday party... a guy like that might turn out to be a Republican.

Better gun him down before spreads!

Dupstick better come up with some evidence that ties the dead Marine to drug dealing. Being a brother of one of the suspects doesn’t cut it, not by itself.

This 'informant' needs to end up in the witness stand, under oath, in a Civil Rights action.

The full article is amazing. Absolutely NOTHING tying Jose to anything except that his brother MAY have been dealing drugs.

A judge approved the search warrant for the four homes on May 3, according to documents.

"A judge", ... A judge?! Who? Which judge? That "judge" has blood on his hands. Did he bother to READ the warrant and supporting "evidence"?

Judges like this need to be removed from their positions and DIS-BARRED, if not tried, convicted, and jailed.

The only thing that needs to be investigated is the murder of this man.

In my experience, admittedly a long time ago, informants get an incredible amount of protection. It began when we swore out that affidavit in support of a warrant - search or arrest, it didn’t matter. We referred to the informant by the pronoun ‘it’, not ‘he’ or ‘she’. Things got more nebulous from there. Only once do I remember a judge demanding to interview the informant personally, and that was after the fact. It seems we were given some bum scoop and arrested the wrong man. His crime? He was family.

None of this stuff is suspicious for a Marine Corps combat veteran to possess. Even the dozen cell phones. Between me, my wife, and my 3 kids, we probably have that many cellphones littering the house since we never throw out our old phones in case we need a back up.

I have several “guns”, several “rifles”,
and there are probably close to a dozen cellphones here if I were to count them all up (me, wife, son, other son, daughter in law, plus a half a dozen older models in a junk box somewhere).

I have a hat that says FBI on it and a jacket that says “security” on it,
I would have some body armor if I thought I could afford it.

Oh, my goodness, I also have some diesel fuel and some fertilizer out in the tool shed and there are some electrical wires and stuff in the pile of junk on my workbench!

I guess all that makes me guilty of something, or at least a suspect in your eyes?

Further investigation is needed.

It's been considered good police practice to complete your investigation before shooting the suspect 22 times with his wife in the house.

A dozen cell phones sounds excessive, but on further thought, I realized I have at least 8 cell phones in my house, of which two are active. The other 6 are old, dead phones.

So, what I get out of the article is if one of my brothers was involved in criminal activity, it would be OK for the police to break into my house and kill me. I guess we really are our brother’s keepers.

A dozen cell phones sounds like a lot, but when I think about it, there are probably more than a dozen broken and out of contract cell phoines laying around my house in various drawers and boxes. I wonder why they even mention that?
