NY judge hits Somali pirate who attacked U.S. ship with nearly 34 years in prison

A Somali pirate who hijacked an American cargo ship received nearly 34 years behind bars Wednesday by a federal judge moved to tears by the tales of his traumatized hostages.

Abdiwali Abdiqadir Muse, 19, calmly apologized as he sought a lesser sentence for hijacking the Maersk Alabama and assaulting its captain and crew before before a dramatic Navy rescue.

It would be a lot cheaper to load him and his ilk on a C-130 and do a low pass over Gitmo Bay. Throw him and his buddies out the back ramp. See if the pirates can outrun the sharks after we give them a rub down in bacon grease. Yummy!!

I'm sorry, but am I the only one that finds something just a little unsettling about this? IMO, judges shouldn't allow their emotions to "move them to tears", or have any effect on the case at hand. That "judge" for the Anna Nichole Smith case in FL(I think it was FL) comes to mind. That guy was an embarrassment.

The pirates are lucky.

Under international law and custom, pirates are considered Hostis humani generis, enemy of all mankind.

The apprehending state can deal with them anyway they wish.

Historically, pirates were summarily tried, convicted and executed.

I like the language of the law. From Title 18 United States Code:

§ 1651. Piracy under law of nations. Whoever, on the high seas, commits the crime of piracy as defined by the law of nations, and is afterwards brought into or found in the United States, shall be imprisoned for life.

§ 1652. Citizens as pirates. Whoever, being a citizen of the United States, commits any murder or robbery, or any act of hostility against the United States, or against any citizen thereof, on the high seas, under color of any commission from any foreign prince, or state, or on pretense of authority from any person, is a pirate, and shall be imprisoned for life.

§ 1653. Aliens as pirates. Whoever, being a citizen or subject of any foreign state, is found and taken on the sea making war upon the United States, or cruising against the vessels and property thereof, or of the citizens of the same, contrary to the provisions of any treaty existing between the United States and the state of which the offender is a citizen or subject, when by such treaty such acts are declared to be piracy, is a pirate, and shall be imprisoned for life.

Darn, law says “imprisoned for life” and he only got 34 years :( Of course this is infinitely better than the sentence he’d receive in a Marxist European country. They’d give him a slap on the wrist and then set him up with state benefits!
