On the rare occasion when federal bureaucrats waver in their commitment to expanding their own regulatory power, environmental extremists can always be counted on to look for a sympathetic judge to expand it for them. The latest clever scheme would undermine the right of Americans to hunt and fish, using the judicial branch to implement policies too hot for regulators or lawmakers to touch. Congress needs to step in and disarm this assault on traditional sporting activities.
The California-based Center for Biological Diversity (CBD) fired the first shot in August when it asked the Environmental Protection Agency (EPA) to ban lead in ammunition and fishing tackle. The EPA quickly rejected the petition, saying it lacked legal authority to impose a ban on ammo. The agency followed up in November with an announcement that a prohibition on lead in fishing tackle was unnecessary. Like clockwork, the CBD and a group of federal, state and local bureaucrats marched into federal district court hoping that a favorable ruling would force the EPA to ban inexpensive, reliable bullets and angling gear.
The case turns on an interpretation of the Toxic Substance Control Act of 1976, through which Congress empowered the EPA with broad regulatory authority - with an important exception. Thinking ahead, the legislators specifically prohibited the agency from applying its power to the restriction of firearms and ammunition. Correct, that’s the problem. They have practically unlimited funds to file lawsuits and don’t have to get the backing of legislatures.
Every time we fight back against Second Amendment violations by citing hunting and fishing, we lose ground.
The only hunting protected by the Second Amendment is hunting of invaders and hunting of tyrants.
Neither has a bag limit, by the way.
A law banning possession of lead ammunition for the purpose of hunting would be perfectly constitutional. A law requiring surrender of lead ammunition would not.

When Carol Browner was in charge of EPA under Clinton in the nineties, she perfected the technique of conspiring with the environazis to have them file lawsuits that EPA would “lose” then pay their lawyer’s fees.
You can bet that Lisa Jackson was in careful cahoots with these people and has probably getting advice from Browner on how to do it.

Please cite the Constitutional provision which says the Federal gov’t can regulate lead, ammunition, or lead ammunition.

I follow you and agree but fighting groups like these that will go to any length to bring about the end of hunting and fishing cannot be ignored.
Each time they win out on something like this it makes the cost of these sports higher. If we don’t fight them on each hair brained regulation the sports will become only sports for the rich.
I don’t doubt at all that Lisa Jackson is up to her eyebrows in this.

Hunters and anglers in Calif are already very fed up with all the regulations and changes made by fish and game. Whats going to happen if this crap gets pushed through are game wardens ( who are only enforcing stupid laws) getting the crap beat out of them by pissed off and frustrated sportsmen.

They got some weird rule where you can’t use lead in some parts of California but you can in others.
You make a good point.
Years ago I knew two CA game wardens well, they were both great guys and even used discretion on some laws when they could. If stuff like this gets passed it will make an already tough job tougher.
