Written by a true stooge who failed to note that the purchases were from private sellers. However, I personally would not sell a gun to a person who said they could not pass a background check.

If the purchase was from an FFL holder, the seller must have a background check made. If it was a private sale, the seller not only has no obligation to have a background check made, he has no means of doing so. If the would-be buyer stated to an FFL holder that he didn't think he could pass a background check, it wouldn't matter. The seller still has to make the check. If the buyer said it to someone offering a private sale, it's pretty much up to the seller. There's no way he can verify it one way or the other.

Private sales are legal in AZ, according to FReepers on other articles about this “sting”.

The sellers broke no laws and one of the other articles around here spells it out.

Bloomberg is a pile of misplaced ego, with a gun-fetish, a presumption to overturn NYC term-limit law, and ambitions to break all boundaries of jurisdiction. Not enough bad stuff can happen to this prime-grade A+ number one Asshole.

New Yorkers get the government they deserve.

This twerp who thinks his billions make him king of the world certainly isn't getting disabused of that notion from the subhumans who voted him in three times.

And they would do it again too.

What Arizona should do is fight back on a personal level.

Go after his family and business interests, I'm sure King Bloomberg has plenty of assets in Arizona that can be tied up in court and be subjected to harassment.

Perhaps it would be best if you were to familiarize yourself with the law. Specifically Title 18, Chapter 44, Sections 921 and 922. You can find them here Title 18, Chap 44 at Cornell

Please pay specific attention to the definitions of a "dealer". Note the difference between that and someone who is selling an item in a private sale that does not meet the definition of a "dealer". Please also note the provisions of 18 USC 922 (d) and note that stating "I may not pass a background check" is not sufficient to meet the prohibition, unless said person actually indicates they are a prohibited person.

As noted in the article, no laws were actually broken. Bloomberg is on a fishing trip and would best be served by cracking down on the criminals in his own city that actually break the law and provide firearms to criminals. Not holding my breath on that.

That is the whole point of the article. These guns were purchased illegally. It's not the purchaser that is at fault, but the seller that didn't follow the laws.

That is not actually in evidence as the article states Bloomberg enlisted the help of Rep Gifford's staff. There isn't evidence from the article that an out of state person purchased a handgun. Bloomberg has pulled this type of stunt before and got his hand slapped hard when he used out of state purchasers. Based on that and what was mentioned in the article I might surmise he attempted to use a state resident to do the purchase but focused on a non-dealer to make the case that the federal law provisions are inadequate.

Almost as bizarre as Bloomberg wasting money sending agents to Arizona when his own state is having an economic crisis, is the curious fact that a newspaper in Minneapolis is joining in.

The libs sure do hate Arizona these days.

If the "undercover" purchasers were not Arizona residents, or were not actually buying the firearms for themselves, then they as buyers were violating the law. IF they were actually Arizona residents, and they were buying the guns for themselves, then no laws were broken by either party. In a private sale nobody is required to do anything because one party says they "might" not pass a background check.

Of course lying about yourself when buying anything, as the purchasers apparently did, is pretty unsavory.

Bloomberg has engaged in a conspiracy to commit a felony. A warrant for his arrest and extradition to Arizona to face charges along with the people he sent should be executed immediately. The weasel needs to face the music for his continuing "misadventures".
