The gunman “was very deliberate in my estimation, very calculated,” said Mr. Kastigar ..." Loughner may be whacked, but is he whacked enough that he couldn't understand that what he was doing was wrong? I doubt it, and in my opinion he's liable for first-degree murder.

Slight Overkill IMHO.
The case against the perp seems pretty easy. The only place to load up on evidence is against the insanity defense, if they are interested.
