WTF? Some of these comments are absurd. This is so clearly unconstitutional it’s disgusting.

“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

If you support this, you ARE NOT a constitutionalist, plain and simple.

That one won't work. I mean if someone is born here, it's a matter of record if they are or not -- and that's all it is. I looked at my birth certificate and it doesn't say that I'm a U.S. citizen, but it does say I was born in Oklahoma ... LOL ...

As to whether they are citizens or not, being born on U.S. soil, that's a legal matter for the country that the states can't affect. To pursue that matter, it will take legislators in Congress to do something about it.

It's one thing to enforce the existing laws about illegal immigrants and also to make sure they are legal (like Arizona in checking on an individual's status), but I don't see an individual state declaring that a baby born in the state is not a citizen -- making it past the first court challenge ... :-)

Hear, hear!

The words “...and subject to their jurisdiction,...” is the centerpiece of this debate.

Citizens and naturalized aliens ARE subject to the jurisdiction and laws of the United States. Those who crossed the border in the dark and hide from ICE and Border Patrol vehicles are NOT subject to our jurisdiction. They run! Heck, they don’t live under ANY jurisdiction!

Therefore, the children of those not subject to U.S. jurisdiction, despite their being born within the boundaries of the United States, are NOT instant citizens. Feel no guilt about denying citizenship to those who aren’t qualified to receive it.

The 14th Amendment (ratified in 1868, soon after the Civil War) was adopted to ensure the citizenship of ex-slaves and their families. Read the Amendment again with that in mind.

Would be a wonderful way for them not to have to foot the medical bills for prego illegals! Won’t do them any good to drop the anchor in AZ.

I didn’t think you could be considered a “natural-born” U.S. citizen if one or both of your parents are illegal aliens??? At least I think that’s the argument a lot of people are making about Obama.

The 14th Amendment never said that EVERYONE born in the USA is a citizen. Tourists & illegal immigrants are NOT under the full jurisdiction of the USA. They don’t pay taxes, cannot be drafted, etc.

I would love to see a legislature force the issue with the courts, and see if they will rule that part of the Constitution - “subject to the jurisdiction thereof” - doesn’t exist.

I’m also willing to support a law that would deport the illegal alien, and give them the option of putting their child up for adoption, or taking him with her. Let the parent choose...
