The White House anticipates that the position Supreme Court nominee Elena Kagan took regarding military recruiters at Harvard Law School, during her time as dean there, will be one of the big points of attack from Republicans.
The policy banning military recruiters from using Harvard Law School’s Office of Career Services had been in place since 1979 because of the military’s ban on gay and lesbian troops serving openly. University policy requires that any employer who recruits at Harvard Law School and uses the services of office of career services must sign a statement indicating that it does not discriminate on various bases, including sexual orientation.
In 2002, under pressure from the Bush administration, Harvard Law School lifted that ban. Under the “Solomon amendment,” passed in 1994, the Secretary of Defense had the legal right to ban federal funds to universities that prohibit military recruiting or ROTC on campus.
At the school’s first reunion for LGBT alumni, Kagan said the “military policy that we at the law school are overlooking is terribly wrong, terribly wrong in depriving gay men and lesbians of the opportunity to serve their country.”
As she wrote in an email to the Harvard Law community, her predecessor had “determined, as did all his counterparts at other law schools, that he should make an exception to the School's anti-discrimination policy in the face of this threat to the University's funding. I left this exception in force this year, once again because of the enormous adverse impact a prohibition of military recruitment would have on the research and educational missions of other parts of the University. This action causes me deep distress, as I know it does a great many others. I abhor the military's discriminatory recruitment policy.”

Ms. Kagan, while attending Princeton University as an undergraduate, entitled her senior thesis “To the Final Conflict: Socialism in New York City, 1900-1933.” In her thesis, Ms. Kagan wrote, “In our times [this was 30 years ago], a coherent socialist movement is nowhere to be found in the United States. Americans are more likely to speak of a golden past than of a golden future, of Capitalism’s glories than of socialism’s greatness. Conformity overrides dissent; the desire to conserve has overwhelmed the urge to alter. Such a state of affairs cries out for explanation. Why, in a society by no means perfect, has a radical party never attained the status of a major political force? Why, in particular, did the socialist movement never become an alternative to the nation’s established parties?” (p. 127).
And then Ms. Kagan issues her call to action, her call for Socialists to unite in order to defeat “the entrenched foe.” She writes, “Through its own internal feuding..the SP [Socialist Party] exhausted itself forever and further reduced labor radicalism in New York to the position of marginality and insignificance from which it has never recovered. The story is a sad but also a chastening one for those who, more than half a century after socialism’s decline, still wish to change America. Radicals have often succumbed to the devastating bane of sectarianism; it is easier, after all, to fight one’s fellows than it is to battle an entrenched and powerful foe. Yet if the history of Local New York shows anything, it is that American radicals cannot afford to become their own worst enemies. In unity lies their only hope.” (pp. 129-130).

If Kagan has indeed chosen a deviant an unhealthy sexual lifestyle, we deserve to know it. Would you want a Justice on the Court who was an avowed alcoholic? How we conduct our lives is part and parcel to our decision making process. A avowed dyke is going to make some very questionable rulings.

you have been a homosexual activist and you are one yourself so tell me how can you be fair on the bench when it comes to homosexual cases?
There is no way this woman should even be making the questions the GOP should release a statement stating how she will nto get the time of day form them until obama puts a qualified person forth instead of people based on agendas and race,religion, sex etc

As long as Kagan doesn’t mind our male soldiers showering with her, or other lesbian, female partners, going to the bathroom together, and sitting around in the ward room in their underwear,...then it is all cool, and I’m for it.
Until she understands the societal nature of such an arrangement, and truly has no trepidations, she should keep her un-lipsticked mouth shut.

Because, as evidenced by the general election in 2008, Americans aren’t smart enough to see through the chaff. Obama got elected in part because of white guilt and “history”.
