U.S. military officials tell NBC News that the U.S. Army will court martial a lieutenant colonel who refuses to deploy to Afghanistan because he considers orders from President Obama to be "illegal."
Army doctor Lt. Col. Terry Lakin believes Obama does not meet the constitutional requirements to be president and commander-in-chief, because he believes (incorrectly) that Obama wasn't born in the United States.

What makes this one different and interesting is that it’s an active duty officer, not a reservist whose orders can easily be revoked.
I wonder why he just now decided an order was illegal? Shouldn’t he have been disobeying all his orders since Obama became CIC?

I don’t know how military courts work, but I could see a liberal civilian judge focusing only on the not following orders piece (not sure if that means he is awol or not) and steering everything away from obama, just like that judge did for that abortion doctor shooter.
Maybe he (naively) assumed that by now one of the numerous other lawsuits would have borne fruit and asked the president to show his birth certificate. When it became obvious that wasn't going to happen, he moved forward? (Just speculating.)

I think he has stated that he does not know where Obama was born. Shoot, I don't know where I was born except for my birth certificate (oh, and my parents' word - which is not good enough for anyone but me).

Lt. Col. Terry Lakin is the highest-ranking and first active-duty officer to refuse to obey orders based on President Obama’s eligibility.
A top-ranking, highly decorated officer in the U.S. Army says he’s now refusing all orders until President Barack Obama finally releases his long-form, hospital-generated birth certificate to prove his eligibility to serve as commander in chief.
“I feel I have no choice but the distasteful one of inviting my own court martial,” said Lt. Col. Terry Lakin, an active-duty flight surgeon charged with caring for Army Chief of Staff Gen. George Casey’s pilots and air crew. “The Constitution matters. The truth matters.”
“For the first time in all my years of service to our great nation, and at great peril to my career and future, I am choosing to disobey what I believe are illegal orders, including an order to deploy to Afghanistan for my second tour of duty there. I will disobey my orders to deploy because I – and I believe all servicemen and women and the American people – deserve the truth about President Obama’s constitutional eligibility to the office of the presidency and the commander in chief.
“If he is ineligible, then my orders – and indeed all orders – are illegal because all orders have their origin with the commander in chief as handed down through the chain of command.”
In his video message now posted on YouTube, the 18-year veteran personally pleads with the president to stop withholding the key document which would put to rest many of the doubts that continue to linger more than a year into Obama’s term.
“President Obama, I ask you to respect and uphold the Constitution. Be transparent and show your honesty and integrity. Release your original, signed birth certificate, if you have one, thus proving your birth on American soil, and thus assure the American people that you are lawfully eligible to hold the office of the presidency and serve as commander in chief of the Armed Forces.”
“Any reasonable person looking critically at the evidence currently in the public domain would have questions about President Obama’s claim to be a natural-born citizen,” Lakin continued, stating this “troubling” information has gone unanswered “because he refuses to release his original birth certificate dating from 1961 and bearing the signature of the doctor who delivered him. This burden of proof must fall upon the president.”
Lakin is the highest-ranking officer to go public over Obama’s legitimacy and the first active-duty officer to do so. Others in the military who have challenged the president to no avail thus far include Army doctor Capt. Connie Rhodes and Army reservist Maj. Stefan Cook.
What was that little slip of the tongue, made by ‘Her Royal Nastiness’ Michelle Obama, about Barak’s “home country” of Kenya? Wonder what the Marxist Stained Media has to say about that?
Doesn’t this add another element to be dealt with though? Won’t the soldier bring a lawsuit to defend his honor, thereby perhaps forcing an investigation into the BC?
I believe 100% this guy was NOT born here, otherwise no reason to spend so much money to fight it and keep his records “hidden”. I see this as an attempt by Obozo to deter others from making similar stances. What a weasel TOTUS is.

If you read his bio, he went to his superiors about this issue and exhausted other options. Its not a new thing that he just ‘decided’ to do this now.
It will be interesting to see how deep the Court Martial goes. Will they just dismiss this officers views or will they allow evidence to prove that he is right? The next question is will this guy use a Military officer as an attorney or will he get a civilian attorney? In some Court Martials.....this is an important aspect. Some civilian attorneys have no respect or understanding of a Militay Court.
