Unrepealable? (DeMint questions about rules changes in bill requiring 2/3 vote and senate adjourns)

Sen. Jim DeMint (R., S.C.) has thumbed through Harry Reid's manager's amendment and discovered some "particularly troubling" rule-change provisions, especially with regards to the proposed Independent Medicare Advisory Board, which he finds could be unrepealable:

If this bill includes a senate rules change (which it does), it would require a two thirds vote to pass.

A court challenge may be in order.

That’s exactly why we need to be armed and prepared long before this ever happens. And with a command structure and nationwide alert system in place. The moment the first Obama citizen’s security force thug invades a home, the alert goes out and millions of armed citizens scramble to full alert status. The government will not disarm our people!! They’ll get our guns business end first!!

It does not. I am a private citizen. You are a private citizen. We are not interstate commerce. They cannot regulate our private affairs as if we were conducting interstate commerce. The congress cannot command me to purchase their health care insurance program or any health care insurance program. Period. And they cannot make it a crime if I don’t. And they cannot take my property or money without due process. I demand a jury trial. I pray millions of Americans follow suit.

They will not impeach. Everyone i know is outraged. We all feel powerless as individuals. I don’t know what the spark will be, but they will never stop unless utterly forced to by the citizenry. They are clearly on a course of central planning and dictatorship. They are even dropping the guise of acting like they are doing our will.

They are determined to direct our lives by force,, we are determined that they will not. One side must give up their plan, or force will be used. No other option can exist logically. I believe they will initiate it against us. When or how, im not sure. Just one opinion here.

They *do not* understand how serious we are about not being enslaved.

Henry Bowman doesn’t agree. Hypothetically now of course, all a central organizing unit does is provide the FBI a convenient address to raid. Review leaderless resistance and a “cell” structure. All that a resistance needs is a central political philosophy.

Central structure is so retro, and oh so easy to deal with in COIN ops,,,

Fighting it every way possible is what I wish to do, and I will.

And even if it becomes law, the probability of the monstrosity standing is vanishingly small. Remember the Assault Weapons ban, that was never going to fall either.

But yes: We need to stop it now, and that, I might suggest, is where you come in.

Suggestion: Yours is a voice that is uniquely respected here. You are the defacto leader. If you were to pin 'orders' onto the top breaking news of activism we might have a cyberarmy.

I agree. The only way they can pull this off is by sheer government force against the people. If it becomes law, then we have to have some sort of nationwide strike against the illegal government. It’ll be time to take the tea parties to the next level. I’d say some kind of tax strike would be in order. To hell with the tea. Dump the tax forms into the harbor. Starve the beast.

Time for all free citizens to rise and resist tyranny!

They think calling it a ‘procedure’ change instead of a ‘rule’ change will fool anyone. I think DeMint should have called them deceitful liers.

What if they are combined? Census workers who are also tasked with the responsibility to tag every gun (and then enter the information into the already set up GPS database of every home in America).

Typically the rules and procedures of the houses of congress have been held to be “political questions” by SCOTUS, which means the courts are hands off and leave it to Congress to figure it out for themselves. There are instances where the courts will get involved, but I’m not sure this is one of them. I’m no expert, but if the rules can be changed that easily without repercussion then we can just as easily do the same in the future. This could backfire on the DEMS. I’d like to see this repealed, and I’d like to see the new republican majority write a bill forbidding federal regulation of health care in the future. I’d also like to see the republican bill have stipulations similar to what the DEMS have put in this bill, i.e., they can’t regulate without 67 votes. It may be just as unconstitutional, but if they can do it, then so can we.
