Appeals briefs scheduled in Obama eligibility challenge

A briefing schedule has been announced by the 3rd U.S. Circuit Court of Appeals in a case alleging Congress failed in its constitutional duties by refusing to investigate the eligibility of Barack Obama to be president, according to an attorney handling the challenge.
WND previously reported on the lawsuit filed by lead plaintiff Charles F. Kerchner Jr. and others against Congress.
Attorney Mario Apuzzo filed the action in January on behalf of Kerchner, Lowell T. Patterson, Darrell James Lenormand and Donald H. Nelson Jr. Named as defendants were Barack Hussein Obama II, the U.S., Congress, the Senate, House of Representatives and former Vice President Dick Cheney along with House Speaker Nancy Pelosi.
The case focuses on the alleged failure of Congress to follow the Constitution. That document, the lawsuit states, "provides that Congress must fully qualify the candidate 'elected' by the Electoral College Electors."
The case asserts "when Obama was born his father was a British subject/citizen and Obama himself was the same."
The Constitution also provides, the lawsuit says, "If the president-elect shall have failed to qualify, then the vice president elect shall act as president until a president shall have qualified."

sounds like a different approach- but I fear the FIX is on on this one and only history will judge who and why this travesty was permitted to occur
Tossed for lack of standing would be my bet. Or a substantive ruling defining NBC in a way that makes Obama one.
O'Bama is stalling as long as he can with the expectation that he will be able to appoint another liberal to the SCOTUS and thus insure his autonomy over this nation.

Short someone walking in with absolute proof Obama is not eligible these cases are not going anywhere. All the cases and arguments here are that Obama ‘has not proved’ he is eligible, in other words, demanding Obama or the courts prove something.
But given he has been in office almost a year the courts wont touch this.
Now is the time for conservative states to include specific language about the proof of citizenship process prior to allowing candidates’ names to appear on primary ballots.
One wonders if the “history of the 21st century” will even BE written.
Too many things are going wrong after all those dreams of hope and change. Liberals are getting depressed.
This birth-certificater stuff is a distraction from that, One which liberals love to talk about. Every day Obama is in office it gets more silly. They seem to think this will be a 2012 election issue.

Amen to that. We already tried it once here in Oklahoma. It got through one part of the legislature, but not the other. So, we'll try it again. It was done in Arizona, Texas and Missouri, too -- but I don't know the results of their try there. Maybe someone else can fill us in on that.
I think that getting a state law requiring a candidate to produce his birth certificate or else he cannot be on the ballot in that state -- is the only way that we're going to fix this problem...

Problem is, this is just about everyone. Some reason Lou Dobbs decided to be the lone birth-certificater voice, but not anymore. He was on Univision pitching amnesty recently to atone for his sins. Few will follow him.
