JAMESBURG, NJ – (Oct. 27, 2009) - Attorney Mario Apuzzo of Jamesburg, NJ, today filed an appeal with the Federal Third Circuit Court of Appeals in Philadelphia, PA, on behalf of plaintiffs Charles F. Kerchner, Jr., Lehigh County, PA; Lowell T. Patterson, Burlington County, NJ; Darrell J. LeNormand, Middlesex County, NJ; and Donald H. Nelsen, Jr., Middlesex County, NJ; challenging the recent decision of Judge Jerome Simandle, Federal District Court, Camden, NJ, dismissing the lawsuit charging that Barack Hussein Obama, aka Barry Soetoro, has hidden all his early life records including his original long-form birth certificate, early school records, college records, travel and passport records, and has not conclusively proven to any controlling legal authority that he is Article II, Section 1, Clause 5 constitutionally eligible to serve as the President and Commander-in-Chief of our military.
Obama was born a British Subject to a British Subject father and Obama is still a British Subject/Citizen to this day since he has never renounced it. According to this lawsuit Obama was born a dual-citizen with dual allegiances, is not constitutionally eligible to be the President and Commander-in-Chief of our military

The Third Circuit is an "appeal as of right"-- they must decide the case one way or the other. After that, the losing party can ask SCOTUS to hear the case, but SCOTUS can refuse to hear it without giving any reason. They hear only about 1% of cases they are asked to hear.

It has to go to the right court. Thats the DC District or SCOTUS. No other court is going to decide that Obama is ineligible. Its just a painfully slow process.
Quo Warrento will come out of this process at some point.
I forgot to mention, he is hiding the fact his father is British. Hiding it right out in the open. Look up Chester Aurthur, and that will tell you a LOT about why Obama is desperate not to talk about his Dad and the fact he is British.
Someone thre me the issue that all Jewish people in America are eligible for Israeli citizenship. That may be true, but they aren’t BORN with it. Obama was born the son of a British father and inherited British citizenship through him. He never was a Natural Born Citizen. He isn’t BOUND by the constitution because he is breaking it by his very presence in the Oval Office. SO don’t wonder why Congress is pushing all of these blatantly unconstitutional bills on us. I don’t trust the Chicago thugs—just look at how Clinton eliminated adversaries. Unless ZERO screws up bad with Obamacare stalling and the 2009 elections, and 2010 looming bad for them, he will be assured a safety net. If the puppetmasters see him as a serious detriment, they might toss him under the bus—but DEMS don’t do that—look at Rangel, the DEM heads at Fannie Mae/Freddie Mac/etc. They might even get that civilian army thingy going!

The problem lies in how much damage he can do before he’s found out. If it’s “later” enough, he could very well destroy this country as we know it, setting the table for someone else to take it over. I agree; I lived through Watergate, and this is small potatoes. It is time for every American to stand up and say “No, we won’t obeny laws that have been unconstitutionally passed by a usurper.” Barry is hiding something big; remember he met with SCOTUS members (all but 1) prior to his inauguration; wonder what the conversation was about? Google it; Barry wanted to tell them something important in private - was it that he couldn’t prove his “natural-born” status?

This may not be news to any of you guys, but it is to me.
So I’m in my history class today and discover the first time a judge refused to hear a case based on “standing” and it was essentially a way to get out of ruling on a case that would get the court in hot water or prove itself impotent in the actual enforcement of the ruling.
Marbury Vs. Madison- Chief Justice John Marshall didn’t want to issue an order to Sec of State Madison that he knew Madison would ignore, but he also supported Marbury’s position. So.... “judicial review” was born and wala, we have the first case of kick the judicial can.
And we see it still applies today. When a judge is a weenie, “standing” applies.
It's not so much the "dual citizen" aspect as it is the lack of both parents being US Citizens. Most Jewish people born in the US have US citizen parents.
Although I know one whose parents were German, but may have been naturalized here after surviving the Nazi death camps. Quiet folks they were. Her husband's grandfather or great grandparents, OTOH, came in through the port of Galveston around 1900, or a bit before.

Thats why Chester Arthur changed his birth date, and tried to cover up the fact his Father was Irish Born British, lived for over a decade in Canada, and was not naturalized until Arthur was about 14 or so.
The 21st President was NOT a Natural Born Citizen either. The only difference is that the American People did not get the information during Arthur’s Term after Garfield was assassinated. One lawyer, Hinman, figured it out, but he was saying that Arthur was born in Canada, due to the fact Arthur changed his Birth year.

Yep. Thats whats being done here. The entire judicial system knows this is a case that MUCT go to SCOTUS. The fastest way to do that is to dismiss on standing so that the plaintiffs can get the right appellate court to appeal it to. Actually winning the case would be the best thing for Obama, because they could conceivably tie it up in court for YEARS by choosing the wrong appellate courts.
Think if it like a chess game. You are going to ahve to make some sacrifices to win, and sometimes what looks like losing is actually just the path to the goal.
The After-birthers all think this is great. They will continue to do so until its actually being argued before SCOTUS at which point they will LOSE THEIR MINDS.

The United States will collectively hold its breath when this Hits SCOTUS. And Believe me, it WILL. Thats what Apuzzo is working for. He knows that it has to get punted up the line through all the proper challenges, because it is a matter of LAW. And because he is demanding that the law be upheld in regards to Obama, it has to be done to the letter of that same law.
Its is achingly slow. But it has to be done right. There is too much at stake.

There is no prohibition against dual citizens being "natural born" citizens.
That's what I initially thought when Obama announced on his website that his Father was a British Citizen. I thought, "Well that's it for him. Father not a US Citizen, ergo, not a Natural Born Citizen, ergo, can't run for President. . . Next case. ." But no, everyone ignored it and the MSM elected him President and Cheney and Congress didn't stand up to him and say, "Hey, You're not a Natural Born Citizen."
I propose a Clarion Call to a huge Patriotic Group of Constitutional Attorneys to band together and put the egos and petty differences aside and get an office in D.C. and start a huge concentrated effort to process the Quo Warranto Law and confront Obama. Start the process and go up to SCOTUS again, or have it dealt with through Congress, whatever the path is. I make a plea for Leo Donofrio, Ed Vieira, Orly Taitz, Gary Kreep and any other Patriotic Conservative attorneys to band together, pool their talents and resources and start the Quo Warranto process as soon as possible. I'm thinking a major push, a Ken Starr Special Prosecutor type effort to push this along. Get 50 attorneys, 100 paralegals, get a huge office in Washington D.C. and give it the biggest full court press you can. If the word got out this was happening, people would donate a Lot. Sure, it's in the belly of the beast, but sometimes you have to engage them face to face. . .
Is this an extreme idea? Was it extreme that the MSM and the powers at be elected a Manchurian Candidate communist last November who is constitutionally not qualified to serve as President of the United States and be Commander in Chief of our Armed Forces? Is your Country worth it? Does the Constitution still matter? I look at my 10 yr old Grandson and think what is the country going to be like when he's my age if this communist "progressive" system takes over the country? Okay, I'm done. . for now.

Don't forget, Watergate was not about the actual crime (a silly, third rate burglary), it was about the cover-up. If I could try to focus and clarify the issue for a moment.
I see a lot of people expounding and arguing about motives and aftermath. As far as I am concerned, these issues are just distractions designed to run out the clock and take peoples focus off of the core issue. The bottom line issue is this: Barak Obama claims that he was born in a hospital in Hawaii. If this is true, then the long form birth certificate will have the name of the doctor and the attending nurse. Barak has stated in one of his books that he has a copy of his birth certificate, so presumably he knows what is on it. He has repeatedly stated that he was born IN A HOSPITAL in Hawaii. If the long form BC does not bear this out, then he has been lying to us.
I should note at this point, that under the laws of the State of Hawaii at the time, one was able to become a legal, legitimate U.S./Hawaiian citizen based solely on an affidavit submitted (even mailed in) by a relative. Obama may or may not have been born in Kenya, he may or may not have been born is a hut in Hawaii, but either way, if his maternal Grandmother (now dead), certified that he was born in Hawaii, then he is legal and legit (unless you can PROVE, which you cannot, that he was born somewhere else). But again, this is not the issue. The issue is: he has stated that he was born IN A HOSPITAL IN HAWAII. If this is the case, then the doctor's signature will be on the long form. If this is not the case, then the long form will reference some attached affidavit. He will still be legal, but he will have spent millions of dollars to cover up the baldfaced lie that he has been telling the American people. THAT is the issue here. The long form BC either WILL or WILL NOT have the doctors signature on it. I wish people would keep their focus on this. As I said before, he could have been born on Mars, but as long as they have the affidavit on file from now-dead granny saying he was born in Hawaii, then he's legal. We can't count on the courts (except to be spineless). The battle field is in the arena of public opinion. The only question before the court of public opinion is: Has Barak Obama spent over a million dollars to cover up the fact that he has knowingly been lying to the American public?

I wish all the major players would have a week long "Convention" and really hash out a game plan. I'm not an attorney, but as I understand it, any US attorney can file a Quo Warranto challenge, i.e., it doesn't have to be the US Attorney from the District of Columbia. C'mon Mario, Ed, Leo, Orly, Gary and all the other attorneys and paralegals working on the Eligibility Issue, come on and work together on this. Millions of Americans would support you in a big coordinated group effort. . .
