Litigation: The Founding Fathers envisioned the states as laboratories for ideas and choices. If the administration needs a demonstration project for successful tort reform, it need look no further than Mississippi.

When President Obama said during his health care speech to Congress that he would "look into" malpractice reform and support "demonstration projects" at the state level, Gov. Haley Barbour of Mississippi, a Republican, responded:

"If they want a demonstration project, come down to Mississippi. I'll show you a demonstration project."

Mississippi enacted tort reform in 2004, including caps on medical malpractice awards. As a result, the number of medical liability lawsuits against Mississippi doctors fell almost 90% one year after tort reform went into effect.

The state's leading medical malpractice insurer dropped its premiums by 42% and even offered an additional 20% rebate to doctors and hospitals on their malpractice premiums.

Some years ago I read that certain counties in Mississippi were magnets as venues for all kinds of lawsuits hoping for big payoffs from deep pockets because the juries were, well, easy. Easy for John Edwards types to roll.

Perhaps their tort reform knocked this class of suit out of the state.

You are correct....author John Grisham built a career on the legal goings-on is MS.

This news somehow must relate to O's attempt to trash the main health provider in MS last week at the joint session. It turns out that the particular health provider is an overwhelming favorite in the state, much loved, and in part I'll bet because of tort reform.

Trial lawyers in Florida have passed around a fake “conservative” anti-Obama ad that is supposed to make Republicans look racist. This ad even has a Republican elephant on it. I wonder if the Republican Party can sue since it uses the Republican elephant trade mark to look like this is an official publication of the Republican Party. Any lawyers out there?
