I sent an e-mail to the Cal secretary of state’s office before the election. The response was that the parties were responsible to certify their candidates. I replied that they must be extremely naive to think that Howard Dean vetted Obama or anyone else for that matter.

Birth certificates if I recall can be requested if pay some fee. They are not sealed.

Presidential candidate Alan Keyes, vice-presidential candidate Wiley S. Drake, and the Chairman of the American Independent Party, Markham Robinson, have filed suit in California Superior Court in Sacramento seeking to bar Secretary of State Debra Bowen from certifying to Governor Arnold Schwarzenegger the names of Electors, and from transmitting to each presidential Elector a Certificate of Election, until documentary proof is produced and verified showing that Senator Obama is a “natural born” citizen of the United States, and does not hold citizenship of Indonesia, Kenya or Great Britain.
In addition, they have asked that the court issue a peremptory writ barring Senator Obama’s California Electors from signing the Certificate of Vote until such documentary proof is produced and verified.
In response to questions about why the suit was being filed, Ambassador Alan Keyes commented, “I and others are concerned that this issue be properly investigated and decided before Senator Obama takes office. Otherwise there will be a serious doubt as to the legitimacy of his tenure. This doubt would also affect the respect people have for the Constitution as the supreme law of the land. I hope the issue can be quickly clarified so that the new President can take office under no shadow of doubt. This will be good for him and for the nation.”

If SCOTUS is truly interested in protecting the Constitution, they will hear these cases. If not, Obama will stand before the Chief Justice of the US Supreme Court and subvert the very document the Court should protect. To me the irony is unescapable.

I dont think it would matter. The constitution does not specify one must be born in the US. It only states you must be a ‘natural born’ citizen and there is a lot of debate about what this means exactly. Some have gone as far as to say being born on an American military installation overseas is not good enough. Others say all one needs is to meet the requirements of being a citizen at birth. Obama would hold citizenship no matter where he was born because his mom was a citizen. The case of McCain is in the middle of the two because he was born outside of the Panama Canal zone it would make his eligibility questionable if using the tighter standard. I think that no matter what is decided the issue needs to be made crystal clear because modern travel will make this issue likely to come up in the future.

I’m telling you right now that if this man is declared inelligible to be President, there will be riots in the streets.
I just looked on the Hawaii Department of Health website. The only type of birth record that one can request from them is a "certified copy" of a birth certificate, which I think is the type of document that Obama has previously displayed. (Personally I believe that this is a real document.)
So what is really being requested here is that Obama "order" that the original vault copy of his birth certificate be displayed. Various speculative theories hold that this original certificate will reveal information not on the modern "certified copy" and that this additional information will somehow disqualify him.
Perhaps Obama could request that the Hawaii DOH take the unusual step of somehow displaying his original birth certificate (which they apparently never do for anyone else), but he can't "order" the DOH to do so, since he has no authority over them.
Perhaps a court could do so, but wouldn't it have to be an Hawaiian court?
It would be such a treat if Keyes actually succeeded in his suit. Obama was very hostile towards him.

Obama has had two years to conjur up the best forged birth certificate that (campaign) money can buy - and if he is foreign-born, I'd be willing to bet he's already got it standing by just in case.
IMO this withholding the certificate is about something else. But what, I'm not sure.
An in camera review by a judge would keep any embarassing details that have no constitutional implications private, while confirming the geographical location of Obama’s birth.
What is the mechanism to enforce the constitutional mandate regarding the citizenship status of a president? Does a candidate have to prove his citiznship status, and to whom? If not, why not? If the proof submitted is dubious, who has standing to challenge it?
And given the practical realities of how we elect our presidents, isn’t the time to settle such questions prior to the election itself?
