Will Rush Limbaugh Be Indicted for Voter Fraud?

As Ohio election officials investigate illegal crossover voting in the 2008 primary, questions arise on Rush Limbaugh's role.

Limbaugh, the nation's top-rated talk radio host, was urging Republicans in Texas and Ohio to skip their party's primary on March 4 and instead cast a vote for Hillary Clinton in order to prolong the fight between her and Barack Obama.

What Limbaugh encouraged Republican voters to do in Ohio was a fifth-degree felony in that state, punishable with a $2,500 fine and six to 12 months in jail.

On Thursday, March 20, the Cleveland Plain Dealer reported that the "Cuyahoga County Board of Election has launched an investigation that could lead to criminal charges against voters who maliciously switched parties for the March 4 presidential primary."

In 2008, 2.22 million Ohioans voted in the Democratic primary, compared to 1.27 million in 2000, according to unofficial results released by Brunner's office. In contrast, 1.01 million Ohioans voted in the 2008 Republican primary, compared to nearly 918,000 people in 2004.

Michael Slater of Project Vote, a nonpartisan group that designs voter registration drives for low-income people, said GOP meddling in the Ohio Democratic Primary was a clear-cut example of fraudulent voting, which is how Republicans have defined the issue in recent years, as GOP advocates have urged state legislatures and Congress to adopt anti-fraud measures such as tougher voter ID laws.

"Here we have a real instance of spurring people on to engage in illegal election activities with a real intent to affect the outcome," Slater said. "That is voter fraud. People were encouraged to break the law. They had to declare allegiance to a political party and sign a document under penalty of perjury. Intent is what matters in voter fraud."

McCain sure isn't going to put up a fight, and THAT is the real problem. The Republicans are running a milquetoast candidate. THAT is not Rush's fault.

ABC News' Teddy Davis Reports: On Wednesday, a top adviser to John McCain said more definitively than he has in the past that he will step down from the Arizona senator's presidential campaign if the presumed GOP nominee faces Sen. Barack Obama, D-Ill., in the general election.

"I would simply be uncomfortable being in a campaign that would be inevitably attacking Barack Obama," said McCain adviser Mark McKinnon in an interview with NPR's "All Things Considered." "I think it would be uncomfortable for me, and I think it would be bad for the McCain campaign."

Even with Rush's advocacy to cross-vote the decision to do such was made by individual voters. Thus the state would have to prove, on an individual basis, whom was "dishonest" in switching registration/cross-voting. They would need witnesses, confessions by the voter etc. And who is to disprove that once in the voting booth some had a change of heart and pocketed the ballot. If the theory is to not cross-over vote because Ronnie Earl and Mike Nifong-type malicious Democrat prosecutors exist the difference is that, again, they would have to mount thousands of individual cases or else none.

Not all at. The prosecutor could covene what's known as a "special grand jury" to investigate "possible voter fraud in the state of Ohio." He could then subpoena every single person (if he wanted) to come before the grand jury to explain why they switched at the last minute. You're naive if you don't think at least a few would spill the proverbial beans about "operation chaos," especially in exchange for immunity.

Then, the prosecutor, having the proverbial ham sandwich to go with those beans, indicts Rush for something. Or, if the indictment looks too iffy for even an out of control Dem, he has the Grand Jury issue a "Special Report" finding that, while insufficient evidence existed to warrant indictment, "some reasonable cause exists" to find that Rush Limbaugh and others interefered with the conduct of the Democrat primary in an effort to assist the GOP chances in November.

The MSM will, of course, jump on that report and make sure it's a front page story about how "evile Republicans" are subverting democracy. Then the narrative will become how the "racist GOP" fought to steal the nomination from Obama and/or how the "corrupt" forces of "hate radio" worked to thwart democracy.

All of which plays right into Hillary's hands, since it makes people forget how SHE tried to smear obama.

Pretty soon, Hillary's in the White House, Janet Reno's on the Supreme Court, Harry Reid is reintroducing the Fairness Doctrine, and Rush and his listener's are sitting around like Wile E. Coyote with an anvil on his head, wondering how they got tricked one more time.

I was responding to another poster who listed many examples of how Rush underestimates the Clintons. This has nothing to do with if he’s perfect or not. But he’s playing with fire with Operation Chaos, and these examples illustrate just that.

True. I see a lot of Freepers are reading this article and calling it (and me) "idiotic" and worse. What they don't understand (and Rush seems to have forgotten) is just how much damage an overzealous Dem prosecutor can do. That's partially why I wouldn't have any sympathy for Rush.

Why would you not be supportive of someone who stands up to an overzealous Dem prosecutor?

After the legal colonscopy he got in Florida on his medical records you would think he'd be more careful.

I'm glad there are people who have the nerve to challenge the Nifongs of the world. Why would you want to enable abusers of the justice system?

This is going to be a great election to sit back and watch with a bowl of popcorn, especially if McCain is smart and picks a solid conservative VP to pacify the base.

The Dhemmroids will either pick a candidate with intimate ties to a ranting racist black preacher, who rails with the “oh whoa is us, we are so oppressed, fight whitey” rhetoric. This type of rhetoric, I am convinced, is hated by 70% of white people nationwide at least (excluding the most guilt-ridden, hand wringing libs). Result: Blue collar dems, union factory worker types stay home or cross over to McCain, McCain sweeps south and picks of Union heavy states like Ohio, GOP wins.

On the other hand, the Dhemmroids pick the wicked witch of New York, and in doing so use superdelegates to over ride popular vote of the party. Result: Blacks stay home, after protesting at convention behind Rev. “Just give me that James Brown Hairstyle” Al Sharpton, any male Dem that still has his testes crosses over to McCain, who sweeps the south again, and the GOP wins.

In a year where the conventional wisdom going in was that the GOP was out on its ear, its funny how the fortunes have turned around. Operation Chaos is working, McCain needs to make just two campaign expendatures: One, sponsor the Jeremiah Wright hour on NPR from now through November, and buy Rush enough Select comfort Mattresses and Allen Bros. Steaks for the rest of his life as a ‘thank you’. (yes, I know Rush could afford his own, but its the thought that counts!)
