A Clinton-appointed judge in California is siding with the Council on Islamic-American Relations in a lawsuit by radio talk-show host Michael Savage.

Judge Susan Illston has issued a terse one-page ruling in the case in which she "granted" a defense motion for judgment on the pleadings with "leave to amend." Although it was released only today, it was dated Friday, apparently finalized shortly after she held a hearing on the issues at hand. It was posted on Michael Savage's website, under the headline "Clinton judge (Illston) sides with CAIR against Savage."

Savage promised immediately he would take the case to the next level, the 9th U.S. Circuit Court of Appeals, which he described as "an even more liberal court – if you can believe it – the most frequently overturned court in the United States of America."

"What I may try to do is have the case removed from California because I cannot get a fair trial," Savage said on tonight's program. "I may remove it to Alabama, for example, where maybe I could get a fair trial – maybe where there's still America. It certainly doesn't exist here in California."

Well, why not go straight to the source and ask his campaign-donation buddy, Jerry Brown, appointer extraordinaire of liberal judges, for help?

Sad, but true...

I’ve known this since shortly after 9/11 when leftist groups started wailing over invading Afganistan..

The only reason most dems went along with it was out of fear.......not of the Talibon....but fear of the American people....they knew if they didnt react...they would be dragged from the capitol by mobs..

(Taking it to the 9th Circuit for Appeal - but isn't that is the Liberal Court of all Liberal Courts?)

I've been saying since about 2 months after the Afghan invasion that we'll need a nuclear firecracker shoved up our collective Hillary Clinton in order to get a WW2-like unity of purpose. That's supremely sad, for this country as well as for those who will be victims and their loved ones.

Yes, saw the line I missed. . .just wondering why Michael is encouraged by this option. But then; he has only just begun; what could be a long road ahead; but so far, no Justice in sight. Certainly not at the ‘9th’.

I don’t like CAIR at all, but I think Savage just shot his mouth off once again and now he’s reaping what he’s angrily sown. I won’t give him a dime for his defense.

Have wondered if that kind of 'unity' is even possible today. Yes, we had some evidence post 9/11; but look how shortlived it was.

The Liberal Left takes a decidedly different tack on issues of 'enemies'. . .even as we see the whites of their eyes; the blood on their hands.

There is certainly truth in 'divide and conquer'. ..which is precisely the MO of our Leftist enemy here at home. See only a 'we unifying'. . .and see 'them' doing the same.

The copyright infringement claims stood little chance since the clips were being used for commentary about Savage, clearly fair use. But good luck on the other charges exposing CAIR as a terrorist front.

The ninth makes rulings that affect most western states. I believe they ruled in favor of partial birth abortion. They did really activist rulings in the past that certainly are archived here. We had their phone number here for a ruling they made a few years ago. Wish I could remember what that was about. We called them a lot whatever it was.

Actually as bad as CAIR is, I could never understand how Savage thought he had a case legally. I don’t think it matters that the judge is Clinton appointed (in this case). It just sounds like a frivolous lawsuit.

He will probably need it. It sounds as if Savage and his attorney are trying to throw everything including the kitchen sink at the organization. That can backfire and alienate a judge who has the consider every single cause of action. If Savage is the only party and he can’t prove he is the aggrieved party on each count, I can see why the judge might send it back for revision. She hasn’t kicked it completely out. He has the right to amend the complaint and get another hearing.

(Truthfully, I don’t listen to Savage lately. I got really tired of his constant anger. When one is always angry, their anger stops attracting attention and, for me, it became a real turn-off.) I think he might have some real points to score against CAIR and I hope he succeeds but he has to proceed very carefully, getting the right allegations, the right plaintiffs and defendants, the right jurisdictions and venues, the right damages or he will get kicked out permanently.
