Belmont bans smoking in apartment houses

The Belmont City Council has passed an ordinance prohibiting smoking in multiunit housing, a measure hailed by supporters as a landmark ban that will give residents relief from second-hand smoke drifting into their apartments and condominiums.

"It's to give people who are intolerant of second-hand smoke a chance to say, 'Please stop - you're violating the city's ordinance,' in the same way that if your neighbor has a loud rock band, you can say, 'Please stop,' " City Councilman Dave Warden said today.

The council passed the measure Tuesday night by a vote of 3-2. The ordinance also bans smoking in outdoor public places such as parks and stadiums, and in "service lines" such as those at ATMs.

Belmont's ordinance would be the first in the United States to ban smoking in multiunit housing, Warden said. The council must still approve it on a second reading Sept. 25; if it does so, as expected, the law will take effect Oct. 25.

Next thing will be to ban smoking in single family homes where neighbors might be able to detect your smoke or if children are in the house. They should just stop pretending they’re trying to protect everyone from second hand smoke and make smoking illegal. That’s where it’s headed anyway.

I don't know how it is in SF but for many years I lived in a 72-family apartment building in NYC. "Quiet Hours" were from 10pm to 6am. A loud rock band or bagpiper or construction crew could make all the noise they wanted outside those hours.

Then the next step will be rental houses.

I owned two rental properties, and even tho I'm a smoker, I had a no-smoking clause in the rental agreements. My property, my choice.

Even as a former smoker - the outrage that comes out of the woodwork whenever this issue comes up is still startling.

I quit 40 years ago, when my doctors finally pinpointed why I was so sick every winter - to the point they recommended surgery on my sinuses. Having my face cut up didn’t sound like much fun...allergy testing proved acute allergy to cigarette smoke.

Long before non-smokers had any rights, I had to leave 3 different very good jobs because of others smoking. I had to curtail a lot of my political activism because of the smoke in the buildings, which would cause me to have acute sinusitis, fever of 105, penicillin and sick for two weeks.

My little 5 year old granddaughter recently was very ill to the point of having to be taken to emergency - with the same problem due to the couple in the adjoining apartment who were chain smokers. The doctor told them she had be gotten out of there post haste and they had to move.

The bottom line is: Your Rights end where my nose begins. You have the right to do anything you want with your life - and your actions, as long as they don’t impact on others. It has nothing to do with ‘socialism’ -

Many landlords are now prohibiting smoking as when the smoker leaves, it costs much more money to rid the carpets, curtains, etc, of the smell of stale smoke. Most smokers don’t realize how bad the smell is - but ask an ex smoker and they will tell you how surprised they were at regaining a much better sense of smell and then smelling others smoking and their clothes and homes - they invariably express surprise that they used to smell like that.

Don’t bother posting back to me - I have no inkling that 99% of you in this thread will agree with anything I’ve said. When it comes to smokers and the facts surrounding the impact of second hand smoke - the smoker goes off like a = well, like a screeching liberal.

I post this not in the expectation of having most of you understand - but just for those few who may out there who who are made to feel as though they are being unreasonable = or much worse, according to some of the comments made if they are bothered by smoke. If you have problems with cigarette smoke - you DO have a right to be free of it.

Why are people living in apartments if they can easily be offened by what someone else does? I thank God that I own my own home on acreage.

Smoking residents should buy a case of candles and several boxes of incense, hang a wreath of pot pourri in front of the ventilation intake, get a year’s supply of cabbage and a truckload of garlic, start cooking and settle in for a busier evening than the worst Halloween you ever saw.>/i>

You all can borrow my son's cat. He can fill a litter box faster than Sea Biscuit! Just place in a strategic location :-D The smallest kitten can yowl "Christmas Bells" acapella. I can probably tape that for you, LOL. Hey how about that stuff that hunters use for scented lure? Stuff the vents with Eau de Civet soaked cotton balls. Be sure and wear a gas mask! That and the cabbage and onions will be a sure hit with birkenstock-wearing hippies everywhere! Lord I'm so ashamed of myself.

You couldn't pay me to even visit San Fransico, which is a shame because it is a beautiful city....

Thats fine. The landlords OWN the property, so they can do as they wish. But its a different story when you have the city council arbitrarily doing it to all property owners.
