I think often the injured parties in such cases are too quick to settle.

From what I understand they were rich already so they probably just wanted it behind them so they could get on with their lives.

Notice - there has STILL not been any condemnation of the lying whore whose lies created this costly and devastating experience for the boy’s families, their own community and Duke University..This is what troubles me most about this whole travesty. The lying whore who caused so much devastation to so many is getting off scot-free. So she has no money...whoopee doo...throw her lying black ass in the slammer and throw away the key as a deterrent to any other black racist whore who thinks she can get her bills paid by accusing white college kids.

I don’t think her primary motivation was that she is racist, though that may be part of the equation.

The primary motivation is that she’s a schizoid nutcase, and incompetent.

She needs some consequences, but she’d probably get off on a mental illness technicality.

The N.C. State’s Attorney has essentially stated that she doesn’t appear competent to stand trial; or, at least, that she isn’t competent enough to prove criminal intent.

Wasn’t that coach the real hero in all this? I just admired him so much. He helped that team deal with it, too. He should be offered a job as President of the University, and the 88 should be looking for Real Jobs.

There is a seldom-considered aspect of this. A settlement gets them money now. While they might get a lot more later, it would be much later, years can stretch into decades as Duke uses its free, in-house law department to delay as long as possible.

Given that the players parents probably borrowed a lot of the money for legal fees, the interest they save by paying them off now is enormous.

Plus, they are wealthy people, they can invest anything left over from the settlement and end up with much more in a decade.

I don't think that the old law of "in loco parentis" is dead. The fact that many have declared it dead, over and over is, to me, a sign of life.

It is no more dead than any fundament of reality can be. The tides of human fashion wave in and out, the march of folly never exhausts.

"In Loco Parentis" could be worked in many ways in this case. The absence of attention by the faculty and the administration to it are, I think, full of torts both before and after the Bad Night of the Strippers.
