Schumer, Feinstein Block BATF Reform Bill

HOUSE PASSES ATF REFORM BILL . . . With a 277-131 vote, the U.S. House of Representatives last week passed HR 5092, the "Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) Modernization and Reform Act of 2006." The legislation, which represents a major advance in protecting the rights of firearms retailers, now heads to the Senate. Sens. Dianne Feinstein (D-Calif.) and Chuck Schumer (D-N.Y.) have threatened to stall Senate consideration. The bill will bring consistency to ATF enforcement actions and provide ATF with additional compliance tools short of license revocation.

Retaining Habeas Corpus - The Senate on Wednesday rejected an amendment sponsored by Sen. Arlen Specter, R-Pa., to the Military Commissions bill that would have allowed noncitizens to exercise the right of habeas corpus if they are accused of crimes involving terrorism.

The vote was 48 yeas to 51 nays.

Clinton, Y; Schumer, Y.

Schumer is all for giving non citizens and terrorists access to Habeas Corpus, but is against protecting the rights of american citizens/gun dealers against over eager ATF/Government agents.

You can't really appreciate the damage the liberals have done to the right to keep and bear arms unless you arm yourself.

Do you know what training and certification your state requires?

Do you know what proof of non-criminality you have to provide?

Do you know whether some past or present minor offense may prohibit you from obtaining a firearm?

Do you know which firearms have been outlawed by your state?

Do you know what waiting periods or scheduled classes might prohibit you from obtaining a firearm in an emergency?

Do you know what laws pertain to the lending of firearms and whether you and/or the lender might be subject to criminal prosecution?

Do you know what storage requirements you must meet and are you prepared to pay any extra costs to obtain them?

Are you aware of any storage requirements that might cause you to face criminal penalties?

Are you aware of your state's requirements for transporting a firearm and/or its ammunition?

Are you aware of any requirements to register firearms that you might receive as a gift?

Are you aware of prohibitions or limitations on carrying firearms loaded or concealed?

Are you aware of legal requirements that must be met to permit a minor to possess your firearm, even with you present?

I could probably come up with more such questions if I thought about it longer. But I think you get the idea.

I encourage you to arm yourself because I am hoping that it will make you angry at liberals and afraid of the path they are taking us down.

But it does not protect gun owners:

-- HR 5092 does not require the videotaping of BATFE firearm tests, which would ensure these tests are conducted fairly and competently.

- HR 5092 does not require the BATFE to establish standardized, written procedures on how firearms are tested

- HR 5092 does not address the BATFE's policy of arbitrarily reclassifying firearms or firearm accessories as illegal, nor require the BATFE to give notice of such reclassification

- HR 5092 does not address the situation of gun owners who may have been unfairly convicted through faulty firearms testing or arbitrary firearms reclassification

We need to let it die and push for HR 1603 (which is bottled up in committee) which does everything that this bill does plus addressed the above issues.
