Ex-labor leader faces new charges

Prosecutors want a former Oak Ridge labor leader and politician accused of rape jailed, and his alleged victim wants $10.5 million from the operators of a West Knoxville health club where the two crossed paths.

Assistant District Attorney General Willie Harper has filed in Knox County Criminal Court a motion to revoke or increase bond set for Carl "Bubba" Scarbrough in a pending rape case.

Harper's motion came hours after Scarbrough was charged Thursday night with driving under the influence and refusing to take a test to measure the level of alcohol in his blood stream.

"Our firm is in the process of investigating the new allegations and Mr. Scarbrough plans to enter a plea of not guilty," defense attorney Gregory P. Isaacs said.

Meanwhile, attorney Timothy A. Priest has filed a lawsuit against the operators of the Fort Sanders Health and Fitness Center on behalf of the parents of the teenage boy Scarbrough is accused of raping in June 2005.

The lawsuit alleges that employees of the Fort Sanders health club in West Knoxville where the alleged rape occurred had a notebook full of complaints against Scarbrough but failed to do anything to protect the boy and other patrons.

"The defendants had notice of previous unusual and alarming behaviors by the plaintiff's assailant including behaviors of a sexual and homosexual nature directed toward other members," Priest wrote in the lawsuit. Representatives of the health club could not be reached for immediate comment Friday.

Scarbrough, a longtime leader of the Atomic Trades and Labor Council and former Anderson County commissioner, is accused of performing oral sex on a 13-year-old boy in a steam room at the Fort Sanders health club on June 9, 2005.

After his arrest, Scarbrough retired from his post at Y-12 and was replaced as labor union chief. Isaacs has attacked the rape charge against his client as dubious. The ex-union chief has been free on bond in the rape case. But his Thursday arrest by Tennessee Highway Patrol Sgt. Larry French could change that if Harper has her way.

"The state contends that the defendant's repeated refusal to obey the laws of this state make him a continuing threat to the community," Harper wrote in her motion.

French alleges in warrants that Scarbrough nearly struck the sergeant's cruiser when the trooper encountered Scarbrough driving on Hardin Valley Road just before 10 p.m. Thursday. After French stopped Scarbrough, he conducted a series of field sobriety tests, which Scarbrough failed, the sergeant alleged. Scarbrough is accused of refusing a test that measures the level of alcohol in the blood, known as a Breathalyzer.

This sicko needs to be locked up for a long time. I'm sure he'll get all the male attention he craves where he's going.
