Anchor babies tie illegal immigrants to US

LEE COUNTY:  "Anchor babies" are children born in the United States to parents who are illegal immigrants. The babies are automatically American citizens and get all the rights and financial help as any other American child. NBC2 discovers what rights these families have and why you're paying their bills.

"His name is Angel, because he's an Angel," said Angel's mother Raquel Angulo.

One-year-old Angel Angulo is American born.

"He was born here in Naples," said Angulo.

His grandparents came to the US from other countries legally.

"They had to go through a whole lot of stuff before they came here," said Angulo.

Babies born in the US whose parents came to the US illegally are often called anchor babies?/FONT> meaning they anchor the family in America.

But there's a misconception. Many people think anchor babies automatically give parents US citizenship, but that's not exactly the case.

Immigration attorney Sam Blanco says an anchor baby has to become an adult before helping their parents with US citizenship.

"For a child to petition a parent, they must be at least 21 years of age," said Blanco.

Unlike their parents, anchor babies can get free healthcare, like Medicaid.

"Medicaid is usually paid by the taxpayers," said Deb Millsap of the Collier County Health Department.

Last year, there were 16,281 Medicaid emergency alien deliveries in Florida. More than 1,737 of those babies were born in Southwest Florida.

According to North Collier Hospital, it costs around $900 for a one-day stay. If all 1,700 babies were born healthy and got the Medicaid Emergency Alien Fund, it could cost Southwest Florida taxpayers $1.5 million.

"It would be easily 10 to 20 times greater, the expense to taxpayers if we didn't spend money on prevention, healthy babies," said Millsap.

The children may end up working in Southwest Florida when they're adults.

"We need all those folks who come to our country, whether they pick tomatoes or whether they are cutting down limbs after Hurricane Wilma, we need these folks," said Millsap.

They may become immigration lawyers.

"I was not born in this country, I am also an immigrant. I was naturalized and became a citizen later in life. That's a reason I do what I do," said Blanco.

Having an anchor baby also gives the parents the right to apply for FEMA aid.

Has this issue ever been decided definitively by the U.S. Supreme Court?

An alien living ilegally in this country is a fugitive from the law and is not "subject to the jurisdiction thereof".

If all it took after the ratification of the 14th Amendment in 1868 was to be simply born on American soil, then why where American Indians not considered U.S. citizens by birth until after the passage of the Indian Citizenship Act of 1924?

"BE IT ENACTED by the Senate and house of Representatives of the United States of America in Congress assembled, That all non citizen Indians born within the territorial limits of the United States be, and they are hereby, declared to be citizens of the United States: Provided That the granting of such citizenship shall not in any manner impair or otherwise affect the right of any Indian to tribal or other property. (Approved June 2, 1924)"

The drafters of the 14th Amendment specifically put in the clause "under the jurisdiction thereof" to distinguish between Americans and non-Americans who happened to give birth on U.S. soil.

Or rocket scientists, heart surgeons, teachers or even a congressperson from Dade County. Every child has unlimted potential given the proper environment and education. The ill-advised and short-sighted idea enacted by Ireland effects the punishment on the Irish people more than on the child at adulthood. We need to staunch illegal entry to the U.S. rather than shoot ourselves in both feet by a constitutional amendment.

I don't think that merely having a kid on US soil makes the kid a US citizen. I think that the parents have to be legal landed immigrants, not just "visitors".

I'm sure someone had posted the laws regarding this on another thread a while back.

In law, evidence, unless gathered legitimately, is called " Fruit of the Poisened Tree" and can not be used in a courtroom.
Children of illegals, I contend, are fruit of the poisened tree and should not be granted citizenship.

Heads up about the Citizenship Reform Act of 2005, that is intended to end this blatant abuse of the citizenship privilage.

If you agree with the premise that this should end, ask your House members to cosponser this bill.

This article is 100% legally inadequate.

The already DID eliminate the anchor babies with the 1996 immigration reform act.

The child is supposed to go back with the illegal parents and then has the right to return at 18.

What has happened is that the immigration lawyers have GAMED THE SYSTEM.

They argue unusual hardship or special needs for the child to stay in the USA.

the LEFT WING judges ALLOW THIS TO PASS.

We need to reign in the JUDGES and IMMIGRATION lawyers who play this game.

How about we simply :

1. Make it a requirement of a Law Licence (ie the Florida, California, Texas etc.) that any lawyer whose client is in the USA illegally SHALL report the name and address to the immigration border patrol. Lawyers who fail to report the illegal status SHALL loose their law license.


2. NO MORE BOND PENDING immigration court hearings.

3. Make the illegal parents ineligible for citizenship. Once the child turns 21. The parents MUST return to the country of origin REGARDLESS OF HARDSHIP, if they are allowed to stay based on some "sham" hardship the judges allow with a wink and a nod.

4. Prohibit immigration judges from appearing in immigration court for FIVE YEARS after leaving the immigration court service. (revolving door, too many judges "retire" and are then trading on their former status.)

Does anyone else find this insulting and condescending? How did America survive a hurricane before illegals.

I am in favor of the Fourteenth Amendment being redefined - even if at individual state levels - to clarify that to qualify for birthright citizenship of the United States, a child must have been born of or adopted by a citizen or legal resident of the United States and that at least one parent or legal guardian must have to verify their citizenship or legal status before a birth certificate is issued by any agency. Any child born in the US not of a citizen or legal resident shall be issued a certificate of birth with non-citizen status clearly marked so that birth may not be used to complicate deportations of illegal aliens. I am also for rejecting of and the nullification of any certificates of marriage issued in the United States to any person who is not or was not legally admitted into the United States prior to the certificate's issuance or the application thereof. Persons who marry in other countries and whose non-citizen spouses wish to immigrate into the U.S. must follow current applicable immigration protocol.

How many illegal aliens are in the U.S.?

According to this article, there are almost 27 million illegal aliens in America. Give or take a few million, there's no denying that we have been invaded, and our leaders haven't had the courage to fire a shot in our defense. Treason? Dereliction of duty? Those at the top are responsible for this.
