Do you have a right to keep and bear arms in California?

NOT ACCORDING TO THE ATTORNEY GENERAL FOR THE STATE OF CALIFORNIA…

Amending the California Constitution is the best way to restore respect for the rights of law abiding gun owners. It will also undermine attempts by local jurisdictions to restrict your right to keep and bear arms. Candidates for political office will also find that this initiative represents one of the best issues upon which to base their campaign for office. ( Remember how Al Gore lost his own state of Tennessee in 2000? ) The Democrats have learned that hostility to gun rights can lose and election. We think supporting gun rights can win one. We need volunteers to put this issue directly to the voters. As a volunteer you will play a pivotal role in making this initiative a reality at the county level. Our goal is 850,000 signatures of registered voters in California and we can only achieve this with your help!

The Proposition:

The inalienable right to defend life and liberty as set forth in Article I, Section 1 of the California Constitution includes the fundamental right of each person to keep and bear arms for the defense of self, family and home. This right shall not be infringed.

1. All State government action regulating the right of law-abiding persons to acquire and possess arms for the defense of self, family and home shall be subject to strict scrutiny, in the same respect as the freedoms of speech and of the press. All county, city and local government action on this subject is preempted by state law and this Amendment.

2. This Amendment does not limit the State from regulating the acquisition and possession of arms by: felons, minors, the mentally incompetent, and any person subject to restraining orders based upon their own violent conduct.

If you are a pro-gun Californian, your help is needed as a volunteer to organize and participate in the collection of signatures in your county. Twenty county volunteers from slightly fewer counties are now identified and their contact information appears on the "Unofficial" web site, rkba.members.sonic.net.

This is excellent progress for the first 11 days of this pre-signature-gathering period. About five weeks remain to achieve the goal of having volunteer teams working in all 58 counties. Following that will be 150 days of signature gathering to qualify the initiative for the ballot.

Read more about the petition language and the overall schedule at the official web site www.tacr.us.

Recommended activities and supporting materials are available on the "Unofficial" web site. Get up to speed on suggested activities by reading the "Past Emails to Volunteers".

To volunteer, email or phone the people listed for your county on the "Unofficial" web site. If there is not yet a person listed, then volunteer to become the contact for your county by sending your name, county, and phone or email address to Dave at rkba@sonic.net.

Your commitment is just what you wish to make it. Whatever you can do is superior to doing nothing. The critical work now is to identify volunteers and prepare to work signature rich environments in each county to make the goal.

I feel it is wrong to keep bears. I would however support arming bears because they are a suppressed and disadvantaged group.

Hell if you have bears in your yard in California you should be able to have "bear arms". I mean that is only fair right?

You have the RIGHT to keep and bear arms anywhere in the United States. However, Tyrants within many states, and within the federal government, might send their Thugs to arrest or kill you if you exercise that right.

Technically he is correct, there is no 2nd ammendment or right to bear arms (guns) in the California constitution. A lot of states as well.

What our constitution does however say we will be government and have the same rights that are included in the Federal Constitution which does have the 2nd amendment.

I am also against the keeping of bears, but I do agree that all bears should be armed. Especially in California.

When the ninth circus court of appeals says something I choose not to listen. Unfortunately their decisions do make a difference to the rest of us. So I say "ABOLISH THE NINTH CIRCUIT COURT OF APPEALS' yesterday.

If this total lying bozo wants to read the 2nd Amendment he is welcomed to. If not, then the NRA and many other organizations ought to remind him in a loud grotesque manner.

If the Federal Government is going to enforce the Bill of Rights and the other Amendments on the Several states then it HAS to enforce it in Kalifornia.

I do agree that all bears should be armed. Especially in California.

One doesn't have the right to equal protection under the law either. Just try being a white boy looking for any kind of job in a government agency. "Sorry, you're not minority enough. Go away..."

Some day we may be as fortunate as Iraq to have a Constitution to live under.

California Liberals come out against guns in public because they don't want to fall from grace within their ranks, but as this article from the NY Post points out, what they do out of the public view is another matter.
