Common sense is missing among the WA State Supremes. Apparently they never heard of the fact parents are supposed to look out for their children's interests and a child's privacy is a matter of privilege.

Let me see if I understand this... If the police wanted to listen into the call, the kids couldn't grant consent because they're under 18 and it would require parental permission. But if a parent listens in, they're committing a crime?

And since when does an error committed by a civilian affect a trial? The parent did wrong, but it is the state who is punished?

If a buddy of his came forward telling about the crime, admitting that he helped his bud get away, that would be considered valid evidence.

This is just plain stupid, through and through. Shame that no legislature has the guts to impeach these idiots and get them off the bench.

EXCERPTS FROM NAKED COMMUNIST

Former FBI agent, Cleon Skoussen, in 1958, in his book, THE NAKED COMMUNIST, revealed among other things, these long term goals of the communist agenda. The information is in the Congressional Record August 1963 and in the Communist Manifesto:

* Get control of the schools. Use them as transmission belts for socialism and current communist propaganda. Get control of the teachers associations.
* Gain control of all student newspapers.
* Infiltrate the press. Get control of book review assignments, editorial writing, policy-making positions.
* Gain control of key positions in radio, TV and motion pictures.
* Eliminate all laws governing obscenity by calling them censorship and a violation of free speech and free press.
* Break down cultural standards of morality by promoting pornography and obscenity in books, magazines, motion pictures and TV.
* Present homosexuality, degeneracy and promiscuity as normal, natural and healthy.
* Infiltrate the churches and replace revealed religion with social religion. Discredit the Bible and emphasize the need for intellectual maturity which does not need a religious crutch.
* Eliminate prayer or any phase of religious expression in the schools on the grounds that it violates the principles of separation of church and state.
* Discredit the American Constitution by calling it inadequate, old-fashioned, out of step with modern needs, a hindrance to cooperation between nations on a worldwide basis.
* Belittle all forms of American culture and discourage the teaching of American history on the grounds that it was only a minor part in the big picture.
* Eliminate all laws or procedures which interfere with the operation of the communist apparatus.
* Eliminate the House Committee on Un-American Activities.
* Discredit the family as an institution. Encourage promiscuity and easy divorce.
* Emphasize the need to raise children away from the negative influence of parents.
* Create the impression that violence and insurrection are legitimate aspects of the American traditions; that students and special interest groups should rise up and use united force to solve economic, political and social problems.

In my journalism law class, the professor [an attorney herself] told us of a story about a parent eavesdropping on her mid-teen daughter who was arranging a rendevous with a middle-aged man. The pedophile did get busted, but he subsequently filed a complaint against the parent for wiretapping, resulting in a conviction for the parent as well.

Needless to say, this story created considerable uproar in the class. I'll see if I can find it...

The Federal wire tapping statue does allow parents to evesdrop on minor child. The intent of congress notes clearly spell this out.

This uproar can be attributed to a journalist's ingnorance of the law, not a bad court decision.

From what I can tell, the Court does not make it illegal to monitor your children's conversations. The decision merely says that such evidence will not be admitted in a trial.

here'a another one everybody will like:
In WS State at the age of 13 the police can no longer make you go home if you are a run away from your parents. In effect after your 13th birthday you can basicly go and come as you please and there's not a darn thing your parents can do about it.
The parents have tried to use the police to gain custody of their 13 year old homeless kids and have been told there is nothing the cops can do.

There is alot of talk on legalities about this "overheard" conversation. However it should not ne a problem for the parent or the court. If i had "overheard" this conversation it would not have been me who informed the police. It would have been my daughter (or else). This would have been direct testimony and permitted as evidence as she would have been a witness. It certainly would not have to be decided by the court.

Did the woman's daughter refuse to be a witness? If this is the case the family really has some ethical questions they need to work out with the daughter. Perhaps a conversation out behind the woodshed would be appropriate.

What nonsense. If a murder were committed and the mother heard the conversation and didn't report it to police she'd be an accessory after the fact. Lately it seems that maybe Washington has been getting a little more like California.

Like police, parents are expected to go to a judge saying, "I have reason to suspect that my child is involved in a crime and therefore I need a legal phone tap...." ??????????????????

This is so ridiculous. Parents have the rights; not the children. This is definately a case where the parents not only have the right to know; but the need to know.

I remember spending the night with my grandparents. My grandmother always listened in on my phone conversations. It took me a while to figure out how she always knew what I was up to. It made me mad; but she loved me and didn't want me to get hurt. Especially the times I wanted to sneak out at night.
