I think I'll send this to Spector and see if this is what he means by Scottish Law. Go Pat go!

I got out of NYS for just these reasons. The inmates now rule the asylum in NY. It is nothing more than a rich-persons playground, and the residents are nothing more than servants, wards of the state, cattle to be tended and used to maintain their domain. I lived there long enough to see it firsthand from the inside, and now view it from the outside looking in.

Nothing short of CWII or the 2nd coming of The Christ will change things, and I don't thing you'll see the former as the people have lost their will to be free...

I don't know where in the US, but I've read that some judges have ruled that the occupant has a duty to retreat (in his/her home) from intruders, i.e., not to defend thier home and property.

Something like that happened in Illinois. The village (idiots) supervisors had made it illegal to own a gun, and a homeowner shot a burglar after his return visit.

Two things:

1) This was reported in The Scotsman but took place in Manchester, England

2) It was an attempted gang hit on a known Gangster and drug wholesaler.

Conclusion: Now two gangsters off the street - hopefully even more when the revenge attempts come.

About 6 months ago Hannity had a guy on who had just moved to NY. The guy had a valid permit back home, had applied for a permit in NY, but hadn't gotton it when someone tried to break into his apartment. The intruder tried to molest one onf the kids, the guy shot him.

To make an example of him the DA prosecuted him to the fullest extent of the law. After much wrangling and publicity it was compromised down to a few months in jail for the black man who defended his family against an intruder with a long rap sheet.

It was discussed at some length here on FR.

Watch your back, there's a lot of govternment officials who wish you and your family ill will.

In the small town where I lived when I attended College, there was an incident in which an armed criminal who was breaking into a home was shot and killed by the occupant.

In a queer twist of legal maneuvering, the homeowner was charged with manslaughter, because even though armed, the intruder wasn't quite through the window when he was shot, and fell outside.

Several weeks later, the local Sheriff came door to door and told us all "If you have to shoot someone breaking into your home, make sure to drag him inside BEFORE you call us"

England is getting so "civilized" they are in grave danger of becoming "uncivilized".

And they just can't figure out why their breaking/entering/murder rate is going up????!!!

They know. They just don't want to say.

"If you have to shoot someone breaking into your home, make sure to drag him inside BEFORE you call us"

Very bad advice. It's called "tampering with evidence", it's easily detected, and it will get you put away.

Far better to wait a few more seconds until the perp is actually inside the house before firing.

if you possess a deadly weapon in your house/business and you INTEND TO USE IT UNLAWFULLY, you may be charged with criminal possession of a weapon (misdemeanor). if you use it do defend your home/business, i believe the worst that will happen is it will be taken away from you.

they probably got him for transporting a firearm across state lines which is a felony and a big no-no.

This is the future of America if the Dems and lefties ever regain control. This is the path that Kerry wants to go down.

You're quite correct!

And that is what I'd do. I merely wanted to point out that not all authorities are as dense in America.

Take note everyone!

They got him for not having the proper permit. Nevermind that he was waiting for whoever issues the permit in NYC to get around to him. The DA was VERY snotty about it all.

well to do it right it's a real process, but you still should do it right. get a local gun dealer to send it to another gun dealer in nyc. then the nypd vouchers it and when you get the proper permit, you can pick up your weapon. good luck getting the permit though.

The father who killed the intruder had been in NYC for about 2 weeks, as I recall.

The point of my original reply was to answer OLV's question about how my trouble someone could get into in NYC if they didn't have the proper paperwork for their guns.

The father did the right thing. He kept his gun with him, in order to protect himself and his family. Just because some goverment officials have targeted those who take their family responsibilities seriously doesn't mean we have to automatically bow to their wishes. The children of the father in question have much to be thankful for, even though the DA was intent on punishing him for keeping an invaluble tool at hand. The DA was/is simply an evil man.
