Man Who Killed Armed Intruder Jailed Eight Years

A man who stabbed to death an armed intruder at his home was jailed for eight years today.
Carl Lindsay, 25, answered a knock at his door in Salford, Greater Manchester, to find four men armed with a gun.
When the gang tried to rob him he grabbed a samurai sword and stabbed one of them, 37-year-old Stephen Swindells, four times.
Mr Swindells, of Salford, was later found collapsed in an alley and died in hospital.
Lindsay, of Walkden, was found guilty of manslaughter following a three-week trial at Manchester Crown Court.
He was sentenced to eight years imprisonment.
After the case, Detective Chief Inspector Sam Haworth said: Four men, including the victim, had set out purposefully to rob Carl Lindsay and this intent ultimately led to Stephen Swindells death.
I believe the sentences passed today reflect the severity of the circumstances.
Three other men were charged with robbery and firearms offences in connection with the incident, which took place in February last year.

Whatever happened to the concept that if a person dies as a result of a crime, the CRIMINALS are charged with Murder in the First Degree ? Apparentely not in Britain. . . . .

Good thing he didn't shoot the robber. Probably would have gotten Life in prison for owning a gun.

Just remember that Kerry would love for us to be more like Europe.
He also loves the court action approach to solving terrorism instead of the military variety.
When I image that judge, I can only see Kerry's face.

I think there was something about he ripped them off on a drug deal and they said they were going to come and take his stuff, and when they did he chased one of them down and killed him from behind. This dude wasn't as lilly white as the story makes him sound.

I've heard crazy stories about Euro land... I had a friend from Holland staying with us for a while and he was amazed that our doors were almost always unlocked, if not wide open (in the summer.) He said, and I can't be sure how serious he was, that if you left your doors unlocked in his hometown (I can't remember the name, but not Amsterdam) that robbers would just walk right in and take your television and stereo while you are sitting on your sofa.

Here are the pertinent facts as I see them without making anyone seem lilly white. 4 armed men break into a home. One of the armed intruders ends up dead.

He can fight this in a higher court, right? Ask Tony Martin how that worked for him. He shot punks that had robbed him 3 times and got hard time.
He was recently denied parole for fear that he might still pose a threat to burglars.
And yes, he's been sued by the crooks.

The drug dealer (man being robbed) chased one of the robbers without the gun into an alley. Stabbing him in the back of the legs as he went, too bad he hit an artery. No loss, the robber is dead and the dealer is doing time.

SCOTUS has ruled deadly force is justified if you use such force because you were in fear for your life or the life of another. This is why you can shoot/kill an intruder in your home--or one trying to break in (nothing to that canard about dragging his body back in).
The SCOTUS makes no mention of weapons. In fact, if an "unarmed" 300lbs hulk attacks some 125 lb guy, then the 125 lb guy can shoot the hulk (physical size is affirmative defense).
UK is nutty when it comes to defending yourself. How can a guy being robbed at gunpoint be prosecuted successfully for defending HIS LIFE. My gawd, they were armed with guns. . .doesn't that say they were willing to use them, and that means the guys life was in danger. I guess in the UK you are supposed to die and let the "authorities" take care of the situation. Piffle.

How can anyone be prosecuted for armed robbery when the biggest armed robber of all is government?
I don't know about Scotland, but in the United States, if government burocrats or corrupt politicians decide they want your property, they'll take it.
They'll figure out a strategy. If one thing doesn't work, they'll think of another--until they figure out a way to seize what they want.
They have enormous resources. They can hire the most brilliant lawyers, whose skills of presuasion and stealth are finely honed. The individual citizen is vulnerable and defenseless against such power.
Robbery? Of course. Armed? Just try resisting!
