Pataki calls for tougher gun laws after cop killings

ALBANY -- On the first anniversary of the day two undercover detectives were shot to death in Tompkinsville, Gov. George Pataki yesterday called on lawmakers to toughen the state's gun laws.

"The murder of these dedicated undercover detectives during an undercover gun buy-and-bust operation serves as a chilling reminder of the dangers our courageous law enforcement officers face every day," Pataki said in a prepared statement, noting he has "repeatedly" called for stronger gun laws.

"On this difficult day, the thoughts and prayers of all New Yorkers are with the families and friends of the two officers who were killed," said Pataki, who called the deaths "cold-blooded murder."

On March 10, 2003, undercover NYPD Detectives Rodney Andrews and James Nemorin were shot and their bodies dumped on Hannah Street.

The undercover investigators had bought an illegal handgun from an accused Stapleton gun dealer -- but that charge alone would merit only a Class D felony upon conviction, possibly punishable by probation.

Under a bill pushed by Pataki, illegal gun sales could land dealers behind bars for up to seven years. He also wants to increase penalties for gun thugs who carry multiple weapons. Present law mandates at least two years in prison -- and up to seven -- for those found carrying 20 or more guns. But they can have as many as 19 and still face misdemeanor penalties, no worse than a year in jail.

Anyone caught with three or more guns would face the new penalties. If caught with 10 or more guns, defendants would face a mandatory sentence of five to 25 years in prison.

In addition, gun traffickers who intentionally lower the number of weapons they sell during single transactions to avoid harsher penalties, would face more jail time and stricter felony charges under the governor's bill, officials said.

"This legislation would save lives by taking these dangerous weapons off our streets, and also protect our law-enforcement officials who risk their lives to stop gun traffickers," Pataki said in the statement.

The governor's gun legislation has passed the Republican-controlled state Senate, where it is sponsored by Buffalo-area Sen. Dale Volker, but has faltered in the Democratic-controlled Assembly.

Yeah, 'cause New York is known for its lax and minimal gun laws. More laws will definitely fix things. They always do.

Fairness has nothing to do with it.....we must respect the law of the land....

This would have been a victimless "crime" in the parts of the country where the citizens can be trusted to handle weapons properly.

In New York where even the cops regularly mishandle weapons, you end up with two deadguys instead.

You can bet that this law will be twisted into a means to jail legit gun dealers who are trapped on paper violations by the ATF.

Seems to me,
If a couple of cops are not tasked with enforcing unconstitutional gun prohibitions,
against "smugglers",
created by the lack of legitimate dealers,
as we have in the Free World,
then no one gets killed.

Gun prohibitions led to these deaths,
and Pataki wants more of 'em.

Gun control doesn't control criminals;
it breeds them.

And if the gun traffickers intentionally lower the number of guns to just one gun then they face double-triple detention and severe time-out periods.

What morons!

Now we can have undercover detectives pretending to be illegal gun buyers so that they can trap illegal gun sellers who may turn out to be undercover detectives. We've all heard of "victimless" crimes. This would be a "perp-less" crime.

Did you know that somebody has a website set up to identify New York undercover cops? I suspect that this may be a greater threat to the NYPD than guns.

Gee what happens when I head to the range with my 12ga, 45-70, .22, .22 handgun, .45, .44mag........ for a day of fun??
Other people I know take more than I do to the range.
Just for the Deer hunt I have the 12ga. 45-70 with the .44 mag with me.
