Hunter Biden attorney Christopher Clark is withdrawing from representing the president’s son in a Delaware probe, pointing to a continuing legal battle over a plea agreement in the tax case that dissolved before it could be approved by a judge.
Clark’s notice to the court indicates he could be a witness in coming challenges over the disintegration of the deal, which the Justice Department moved to withdraw minutes after Attorney General Merrick Garland elevated Delaware prosecutor David Weiss to serve as a special counsel in the matter.
“Based on recent developments, it appears that the negotiation and drafting of the plea agreement and diversion agreement will be contested, and Mr. Clark is a percipient witness to those issues,” Clark wrote.
He went on to cite Delaware professional conduct rules dictating that “a lawyer shall not act as advocate at a trial in which the lawyer is likely to be a necessary witness.”
Clark has represented Biden throughout the five-year investigation and helped broker the plea deal.

The Biden Justice Department moved to withdraw minutes after Biden Attorney General Merrick Garland elevated Delaware prosecutor David Weiss to serve as a “special counsel” (at Weiss’ request) in the matter......disregarding a rule stating a special counsel must be from outside govt.
It appears that the negotiation and drafting of Hunter’s plea agreement and the deal-breaking ‘diversion agreement’ will be contested.
“Mr. Clark is a percipient witness to those issues,” Clark wrote.

This requirement is the law. The regulations were authorized by Congress under 5 U.S.C. 301, 509, 510, 515-519.The attorney general is the chief law enforcement officer of the United States. It is certainly expected that he would obey the law in its entirety.

Yeah, that used to be a thing. It certainly went away with Trump. But breaking that veil wasn’t right for Trump and doesn’t make it right in Hunter’s case either.
Hunter Biden was all aglow, set to skate to freedom with
plea deal that included a hidden deal for his father’s criminal activities.
Hunter was set to plead guilty to nothing tax charges and to settle a gun charge wherein he lied, during a July 26 hearing in Delaware, but the deal unexpectedly fell apart during the court hearing before a very astute judge.

Prosecutors’ formal move to withdraw the plea deal indicated they plan to seek charges outside of Delaware, instead, addressing the charges in either Washington, D.C., or California.
The listed locations reinforce testimony from two brave IRS whistleblowers who complained about Delaware’s Weiss’s handling of the case, and suggested there may be stronger evidence in the two other jurisdictions mentioned.

There was no agreement. The judge proved that. Additionally, any “agreement” has to have a 3rd party (judge) also agreeing/approving the agreement. What a maroon. He just wants out. It hopefully gets messier.
