Question for Packing Texas FReepers: 30.05 Signs

We are now a little over a month into the Constitutional Carry era in Texas. As most of your probably know, HB1927 included the creation of a new "30.05" sign to go along with the familiar 30.06 and 30.07 signs. If you don't know, and you carry a handgun in Texas with or without an LTC, then you should look it up and familiarize yourself with the effect of each sign.

My question: Have you seen any 30.05 signs in the wild yet? If so, did they replace a 30.06 and/or 30.07 sign from before, or were they put up in addition to it?

I've seen two 30.05 signs so far. One at a Chinese restaurant near Downtown Houston, which was posted in addition to the pre-existing 30.07 sign, with no 30.06.

The other was at a credit union in the downtown Houston tunnels. That credit union was previously one of the few businesses with both a 30.06 and 30.07 sign. Now both signs are gone and are replaced with only a 30.05 sign.

They refer to very specific signs required to notify LTC holders that the property owner does not consent to their entry with either a concealed handgun (30.06) or an openly-carried handgun (30.07). Both signs are required to prohibit all carry by LTC holders. Signs that do not contain the required language or meet the other requirements are ineffective. Without a compliant sign, an LTC holder is only trespassing if he remains on the premises with his handgun after being orally informed that it is prohibited.

A 30.05 sign applies to those without an LTC, and states: “Pursuant to Section 30.05, Penal Code (criminal trespass), a person may not enter this property with a firearm.”

To be clear: to prohibit all carry, one must post all three signs. So, by my examples: The Chinese restaurant apparently made the deliberate decision to allow only licensed concealed carry. The credit union, which previously prohibited all carry, has inadvertently allowed all carry by LTC holders.

I see Everytown claims that a noncompliant sign “will not legally prohibit people from bringing firearms into your establishment - but it will convey your preferred policy to responsible gun owners.”

I assume such a business owner knows his sign is noncompliant. So what the “preferred policy” a noncompliant sign conveys to this responsible gun owner is that I am welcome with my concealed firearm, and that the sign is merely a placebo to assuage the fears of the bedwetters who are afraid someone else might be carrying.

Here’s a couple examples. Sometimes when carrying under a coat or jacket the gun will inadvertently be flashed. Another is when carrying in a pocket the gun will print. In other words an outline of the gun can be perceived.

Did they seriously put this in the Penal Code under the heading Section 30.06? (Along with 30.05 and 30.07) That’s next-level trolling if they did this on purpose.

I’ve noticed that unless the gun is very poorly concealed (or if you look or act suspicious), very, very few people in public are (1) observant enough to notice the occasionally-flashed or -printed handgun; (2) inclined to care about it; and (3) bold enough to say or do something about it.

That said, I generally don’t recommend ignoring 30.06 signs.

They wouldn't, if you're doing it right. Some do it wrong, though.

Frankly, I wish the LTC course got rid of the irrelevant segment on gun safes and the mandatory "law shield" ad, and replaced it with a discussion of proper holsters and concealment.
