According to the constitution the President of the Senate, vp Pence, presides over the electoral vote on January 6.
But what if he resigns instead? Right then and there. There is no President of the Senate then.
So what is the constitutional remedy and what do you suppose will happen?

One scenario.... Trump could refuse to accept Pence’s resignation.
Hubert Humphrey declined to count Electoral votes in January 1969, the President pro tempore of the Senate did it instead.
In case Pence resigned, the votes would be counted by either Chuck Grassley or Dianne Feinstein, depending on the outcome of the Georgia races the day before.
Pence was not appointed by Trump and does not serve at his pleasure.
Why would he do that? If there is no vp there is no president of the senate which means that constitutionally that role in the electoral process can’t be fulfilled...right?
But Trump is Pence’s boss........

I think I’ll start a competing thread: “What if the Canadians Attack From The North on Jan 5th? Can Trump declare a national emergency?”
And there would be a difference between a vp who declined to do it versus a scenario where there is no vp....right?

Constitutional order of succession
Trump is absolutely NOT Pence's "boss".
Pence was elected by 303 Electors for Vice President appointed by the State Legislatures, his term ends at 11:59 am on January 20, 2021, and while it is not a good career move for a VP to become the enemy of the sitting President it has occurred before, and although a President (in theory) can make a VP's life hard, he can't order him around and he certainly can't fire him.
I thougt that was only for office of president, not vp. Pelosi doesn’t become vp if pence resigns.
Someone on another thread was arguing that Trump should fire Pence. They actually thought that could be done.
No, not at all. The designee to preside then would be the Senate President Pro Tempore.
That said... it probably *would* be wild.
