'This is what we do to kids in Mexico': Drunk stranger 'spanks man's toddler son' in a grocery store after hearing the two-year-old cry when he was told he couldn't have a candy bar A drunk man was arrested in a Georgia grocery store on Tuesday after allegedly spanking a stranger's toddler son when he heard him whining that he was not allowed a candy bar.

Juan Guvarra Martinez, 62, was standing behind James 'Logan' Morris in line at a Kroger in Newnan, near Atlanta, on Tuesday.

He overheard Morris's son ask for a candy bar and watched as he began to cry after being told no.

The man is then said to have grabbed the boy by the arm and hit him around the wrist before twisting him round to spank his bottom three times.

According to boy's father, he told him: 'This is what we do to kids in Mexico.'

Morris, a plumber, was calm and took his son back, saying: 'Buddy, we are not in Mexico.'

He paid for his goods and sent his son and the rest his family outside then waited as police arrived to question the man.

Video of them arresting Martinez, who was dressed in construction worker's clothes, was obtained by The Newnan Times Herald.

It shows him standing by the cash register, confused as he is put in handcuffs.

According to the officers, he reeked of alcohol and seemed drunk.

Morris said the man hit his son three times on the backside. The child stopped crying and was in shock, he said.

Wherever and whenever the shoot is, court will follow and murder is on the table. This scenario isn’t unique.

“You don’t spank children today,” said Judge Jose Longoria of Corpus Christi’s 214th District Court. “In the old days, maybe we got spanked, but there was a different quarrel. You don’t spank children.”

Rosalina Gonzales had pleaded guilty to a felony charge of injury to a child. As part of the deal, she is required to take parenting classes and pay $50 to the Children’s Advocacy Center.

Prosecutors described it as a “simple, straightforward” spanking case that didn’t involve a belt or leave bruises.

Gonzales was arrested in December when the child’s paternal grandmother says she had noticed red marks on her behind and took her to the hospital.

The three children have been placed in the paternal grandmother’s custody until the Department of Family and Protective Services determines that Gonzales is ready to have them back.

The Texas Attorney General’s website explains that spanking is permitted under Texas law if it does not cause injury, but it could be deemed abusive if not confined to the buttocks or if certain instruments are used. “A blow that causes a red mark that fades in an hour is not likely to be judged abusive,” it says. “On the other hand, a blow that leaves a bruise, welt, or swelling, or requires medical attention, probably would be judged abusive.”

Spanking has become a hot-button issue, with debates raging over the practice’s effectiveness and certain groups calling for it to be outlawed outright as a form of child abuse. Many pro-family groups have argued, however, that the state’s effort to clamp down on spanking, in cases where the child is not injured, represents an unjust usurpation of parents’ proper authority over their children, and their right to discipline their child according to their own conscience.

EXACTLY - I wasn’t spanked and I was a total brat, barely keeping out of jail. I learned. My kids were spanked and are angels.

Thanks-I do remember hearing about that and it appears that the mother did do bodily harm-but the judge’s personal opinion on corporal punishment is irrelevant-she is not there to make laws.

I don't know about a stranger administering necessary punishment, but it appears the child was severely misbehaving. To all of the folks on here ready to beat someone up/kill for such instead of calling the police, you'd better think twice. My moniker is what it is for a distinct reason (research it). You are the ones counting on a third party observer standing by while you beat someone to death or shoot them.

It's not so much what you don't know that will get you in trouble, it's what you know that ain't so. I have nothing to lose anymore. Nothing. It might be better if you state what you think is right or wrong about the situation without the threats. Now, some of us know what you plan to do and if you do it....

Think the judge was a he.

Plus the child only had a few red marks. We had them as kids. the kids was not black and blue. Don’t know where you draw the line on red marks but just saying we lived.

Police shooting and killing people when they could have just tazed or injured the person?

Police arresting kids in schools for misbehaving when in years past those offensives would have been punished by suspending or...dare I say it? **gasp** SPANKING! Yes spanking by the principal’s electric paddle!

It should not even get to calling the police. Parents should nip it in the bud.

I would never spank anyone’s kid, but I have on occasion told parents to put on their dad pants and straighten their kid out.

I suppose by those standards, we were abused as kids-when we were 8-12 years old, we had our legs switched with the small branches of dogwood and other flexible bushes, like other ranch kids did for doing stupid and dangerous stuff like going into the pasture with a bull then leaving the gate open, playing war with a real firearm or otherwise using one unwisely-and the gun(s) were taken away for weeks-we survived, too, but that was another time and place...
