Florida ‘Muslim-free’ gun shop owner wins discrimination suit

A federal discrimination lawsuit filed by a Muslim activist group against a Florida gun retailer owner who declared his shop a “Muslim-Free Zone” has been dismissed.

U.S. District Judge Beth Bloom ruled that Florida Gun Supply owner Andy Hallinans sign was protected by the First Amendment, and the activists couldn’t prove they were injured by the action, a local NBC affiliate reported.

The plaintiff, the Council on American-Islamic Relations (CAIR) Florida, has 30 days to appeal the decision.

Mr. Hallinan made headlines earlier this year when he declared his Inverness store a 'Muslim-free zone' in the wake of the shooting of four servicemen outside a recruiting office in Chattanooga, Tennessee, by an Islamic extremist.

Shortly after the courts decision to drop the case, Mr. Hallinan posted a video to Facebook celebrating the victory and said he will give out bumper stickers for customers to turn their vehicles into Muslim-free zones. He is also selling 'jihadist targets' for shooting practice.

One of the indisputable realities of American gun purchasing guidelines and rules with the ATF (and thus the government) is that besides the NICS check and Form 4473 responses, the gun dealer/salesman is the last line of defense in preventing the wrong people in getting a gun.

This means that if the salesman has any apprehension at all about the sale, he can stop it AT WILL.

Absolutely, because sure as the flies on Obama's face and the rats at his feet, any terror attack that ties back to a firearm sale by that dealer will be most vigorously used against him.

Republicans have standards, and we try to hold our leaders to some kind of standard. Because of this, the Democrats use it against Republicans for political points.

I would wait to see how the appeal goes before celebrating this too much.

I would bet this gun shop would need a state license of some sort and would not be able to discriminate against anyone in the public regardless of what group they belong to. Unless the law says who to discriminate against like minors or obvious intoxicated people etc.
This case isn't a private matter, it is a public matter.

Myself, I believe that business owners should be able to discriminate against customers they don't want to have on their premises.
In the past the courts don't seem to agree with me on that, if a business has a state or Federal license to transact business. -Tom

If I had a gun shop I would have a skillet frying bacon, every hour of every day I was open, right by the front door. To get in the door you eat a piece of bacon and then stroll to the displays.
