The man was out on bail for the very crime he was being arrested for. He knows the drill well, turn around and put your hands behind your back.
Everything that transpired that tragic day was the result of Mr. Garners actions.
When the officer was effecting the arrest Mr.Garner pushed his hand away. Mr.Garmer stated, and I paraphrase ‘ I’m tired of this, this ends today ‘.
If I’m the cop and he says that to me, I’m taking that as a direct threat.
As they say, there are two ways we can go here. The hard way or the easy way, Mr. Garner choose the the hard way. When you are a morbidly obese asthmatic with cardiac issues it’s best to go easy.
It is indeed tragic that Mr. Garner lost his life for all concerned. It was his actions that led to his death. His statement “ this ends today “ in hindsight appears prophetic.

The "resistance" was passive resistance, at most. NYPD officers are required to abstain from using force when possible, and to use the minimum force necessary to overcome resistance. With at least five officers around him at the time, there was no need to "take him down." They wanted to show Garner who's boss, so to speak, and he ended up dead. Wholly unnecessary, and pretty shameful to see Freepers defending it.
But, but, I keep reading people post that the autopsy showed no damage to his neck?? There's no way all of those people could be full of it, is there? /sarc
Then had all five cops drawn their weapons and opened fire on Garner you'd be okay with it because of the 'direct threat', right?

No, had he brandished a weapon such as a knife or handgun then yes I would have no problem with your scenario.
That’s why I stated that I was paraphrasing. “ i’m tired of it. It stops today “. What stops today? Garner stops selling cigarettes on the street? The Police stop arresting him when they observe him engaged in criminal activity? He’s gonna kick the cops ass?
He’s out on bail and he gets bagged again, he should have went peacefully. A man that large can grab you and throw you through a plate glass window before you can say Jackie Robinson. He could bite you and sever your carotid artery.
Until he is completely under control he is dangerous i.e. cuffed.
I take no satisfaction in this mans death, it is tragic for everyone involved. Mr. Garner made the decision to sell the smokes while out on bail for the same. Mr. Garner when confronted indicated with words and movement that he wasn’t going to be taken in. He made some very poor decisions that day, unfortunately because he had multiple health issues it cost him his life. There was no intent to kill him and that is what the Grand Jury found.

Some are saying that it’s a small crimes selling untaxed cigarettes. Hamas ran a huge smuggling ring from the Carolinas to the North East for years before they got popped. Also It’s no small amount of money to the folks who pay high rents on Staten Island to run brick and mortar convenient stores.
New York City after David Dinkins was a crime ridden rat hole.Times Square was not a safe place or the showplace it is today.
You spoke of Rudy Giuliani who is a very intelligent fellow. Rudy studied the crime problem and knew how to fix things. One of the very first orders he gave to the NYPD was to place cops at all the turnstiles into the subway system. Rudy wanted them to arrest all turnstile jumpers. The top brass thought he was nuts to waste all that manpower on such a petty crime. Rudy figured out something that they didn’t know. Most turnstile jumpers were recidivis felons or criminals with outstanding warrents.
The mood in the city had cooled considerably as street crime dropped like a rock.
I saw some of the take downs at the turnstiles, getting arrested today is not on a criminals to do list and many were violent when they got pinched for something that paying a dollar would have taken care of. It was brilliant.
