Elizabeth Daly, now 21, and her friend had their car swarmed by state agents after their case of water was mistaken for beer Daly had initially sought $40million in damages for a tremor in her right hand, intense anxiety, post-traumatic stress disorder and other problems The young women had been shopping at a local Virginia grocery store one night in April 2013 for a charity fundraiser the next day A college student in Virginia reached a $212,500 settlement on Wednesday following her arrest last year when state agents had mistaken a case of water for beer.

Attorney General Mark R. Herring announced that Elizabeth Daly, now 21, had reached a settlement in state court. She had initially filed a $40 million federal lawsuit against agents with the state Alcoholic Beverage Control unit.

Herring said the settlement was not an admission of wrongdoing by any of the parties in the lawsuit.

Daly had left a Charlottesville, Virginia, supermarket in April 2013 when her car was surrounded by state ABC agents, one of whom drew a firearm and another who had jumped onto the hood of her car.

They had mistaken her carton of La Croix sparkling water for beer that her friend had purchased.

Daly said she became frantic when unmarked agents surrounded her vehicle, banging on the windows and demanding that she roll them down. One of her two friends in the car had allegedly said that the badges were fake and told her to 'go, go, go' according to the lawsuit cited in the AP report.

Unsure whether they were in fact agents, she and her friend fled the scene in the car, grazing two of the agents in the process.

For $200,000 the cops can terrorize me anytime. These cops made asses of themselves. Too bad the $200,000 doesn’t come out of their paychecks.

any awards should come out of the offending officers’ pensions, and then the police chiefs’ and the officer hierarchy in charge too.

These lunatics should’ve been jailed.

The ABC should be abolished anyway.

Virginia is a police state.

She let them off too easy, especially in that they’re admitting no wrong doing. I would have held out for a LOT more and a public apology, or else gone to the jury.

the charges were later dropped and her record was expunged.

Expunged but it will never go away and will pop up when she applies for a job or to a school. She may not know that it has come up because she probably won't be told why she has been denied.

Do not trust ANY cops of any kind. They all work for the FEDS now. They are allowed to run amok for practice so they will kill when the FEDS unleash them on constitutional citizen militias.

Just wait until anti-cop jihadists show up with their fatwahs. I too would like a big fat taxpayer-funded paycheck for an arrest any day of the week.

$200K for a year and a half of legal representation during a suit against the state? That’ll leave her with nothing.

“Underage”? You can be arrested in kindergarten these days if you draw a gun, how can anyone be underage to be arrested?

“For $200,000 the cops can terrorize me anytime. These cops made asses of themselves. Too bad the $200,000 doesn’t come out of their paychecks.”

Money isn’t everything. These crazy thugs could have shot two innocent girls who were simply trying to run for their lives from what looked like a rape attempt. It is a shame one of the officers didn’t end up dead. Maybe then they’d learn to restrain their enthusiasm for thuggish behavior. This was insane behavior that should not be allowed.
All this over something as small as under age drinking. And not even guilty of it.

To the LEOs here, what is it with plain clothed cops not being able to understand that you succeeded in your goal? We don’t know you’re a cop. You don’t look like one, and we have no reason to believe you are one. Anyone can shout “Police” and then rape you after you cooperate. Heck, the criminals are learning to do just that. This kind of stupidity can get people hurt or killed through misunderstandings like this.
If you aren’t in uniform, don’t be stupid enough to expect us to know you’re a cop. Especially get crazy aggressive like these idiots. In this situation, these girls had only moments to make the choice on how to react. Moments. Do you honestly expect people to ‘wait and see’ in this kind of situation? If you do, they all you care about is yourself and law. You don’t care about the people this activity can harm.

The question will be “Have you ever been arrested?” doesn’t matter or asked for what or if you were exonerated .... it’s there.

That's one of your dumbest comments yet, of which there are many.

The drug war posters never sound off about police raids when minors buy beer.

Additionally, if we look to the age of consent laws, being “nearly legal” is now considered legal if you are close enough in age (within a few years).

Why do the police even concern themselves with such matters?

The drinking age should be decided locally instead of federally (blackmailed in compliance by the withholding of highway funds from gas taxes).

I remember when this was fresh news.It was pretty absurd. I agree that she should have held out for much more and an admission of wrongdoing. She was lucky that the occupants of the car were not summarily massacred.

How does one confuse a case of water for a case of beer??? That is just plain stupid.

“That’s one of your dumbest comments yet, of which there are many.”

How is it dumb? Wasting hundreds of thousands of taxpayer dollars on a hit-and-run suspect? Oh, I am sorry. Her charges were dropped because the mob wanted her off the hook. How convenient - run over cops and get off the hook!
