Man seeks green card after American husband dies

An Australian man widowed by his American husband of more than three decades made a renewed pitch Monday for a green card after the Obama administration eased policies on gay marriage.

Anthony Sullivan, 72, asked federal immigration authorities in Los Angeles to reopen a 1975 petition filed by his late husband Richard Adams so Sullivan can be awarded residency as the surviving spouse of a U.S. citizen, immigration attorney Lavi Soloway said.

The request came decades after the couple sued and lost an early effort to win immigration benefits for same-sex married couples, and less than a year after the Obama administration started issuing green cards to gay couples who marry. Adams died in 2012 in the couple’s Hollywood home. …

There is much federal law involving gay marriage (military, federal employment, immigration, it is one reason that we need a president that opposes it at the federal level (that opposes it period), not to mention when choosing judges and the Supreme Court.

Rand Paul doesn’t oppose it:
“I think that the Republican Party, in order to get bigger, will have to agree to disagree on social issues,” Paul advised. “The Republican Party is not going to give up on having quite a few people who do believe in traditional marriage. But the Republican Party also has to find a place for young people and others who don’t want to be festooned by those issues.”

Adams and Sullivan received a marriage license from a county clerk in Colorado in 1975. Other same-sex couples To my knowledge, the Colorado Supreme Court never resolved (and will not likely resolve) the issue of whether these were lawful marriages under Colorado law. It should be noted they were plaintiffs in the Adams v. Howerton case. Two district courts in the Ninth Circuit had actually relied on Adams to uphold DOMA. here and here
