Lawyer: People should be ‘outraged’ (video - NMSP officer shoots, kills driver during traffic stop)

Dash-cam video released Thursday shows a State Police officer running toward and alongside the car driven by Jeanette Anaya and firing multiple times into the Honda sedan as he screams expletives and for the occupants to get their hands up.

Anaya’s car did back into officer Oliver Wilson’s cruiser, apparently narrowly missing Wilson himself, but the video shows that the Honda was moving away from Wilson as most of his 16 shots were fired.

Anaya, 39, was hit and killed by two of Wilson’s shots, following a vehicle chase that started when Wilson tried to pull her over for a traffic stop after midnight on Nov. 7.

When the shooting took place, Wilson was outside his patrol car. He had used a bumping maneuver to force her car to stop on Camino Carlos Rey. All within just a few seconds, Wilson gets out of his car, Anaya backs into the cruiser, and Wilson starts shooting at Anaya’s Honda. A passenger in Anaya’s car, Jeremy Munoz, 34, was not injured.

Earlier this week, a Santa Fe County grand jury ruled that Wilson was justified in firing at Anaya and that he will face no criminal charges. Wilson testified he feared for his life when Anaya backed into his police car, according to District Attorney Angela “Spence” Pacheco.

But Tom Clark, attorney for Anaya’s parents, said Thursday that Anaya should have stopped during the car chase but that if Wilson wasn’t wearing a police uniform, he’d be facing a first-degree murder charge now.

Clark said he was “shocked and dismayed” after viewing the video.

“I had no idea it was going to be as bad as it was,” he said. “I didn’t think it would be so dramatic with the officer running alongside shooting point-blank into the car.”

There are dangerous people. There are stupid people who do dangerous stuff. There are people who make poor decisions.

She chose poorly when she decided to run. IMO that is not worth the death penalty delivered summarily by law enforcement.

If he shot at her as she was backing into him I’d be ok with it. She was putting his life in danger. Although there’s an argument that his stepping out of the car into that position was what put him in danger.

Him running beside her car to shoot at her is murder in my book.

She was driving erratically and the officer was right to maneuver her over as he did. However erratic driving is not a capital offense and she was driving away when he shot at her. That in my opinion was not justified.

I used to think that having videotapes rolling would keep these incidents from happening.

But no, they seem to be proud of their work and soon, we will see them on YouTube with the title "OMG WTF I capped dis dirtbag and hes all DEAD LOL"

The cop has responsibilities to all of the other citizens out there too. This lady had been observed as a reckless and dangerous driver and had committed assault with a deadly weapon almost running over the cop with her car. Everyone in her path was in danger. Officers have responsibilities to stop out of control people who have committed dangerous life threatening criminal acts before they injure or kill others.

After her continued and clearly visible mindset of total disregard for the safety and lives of others she had to be stopped. That was his job, his responsibility.

She was not the victim in this, she was the aggressive and callus perpetrator.

However, every single person who runs is at that time in the commission of a felony.

And that is as it should be. Policemen, however, have a broader spectrum of authority. They can require you to stop. Not ask; require.

And speaking of “affirmative action”, what about that yankee city PD that brought in blacks who couldn’t read, just so they could meet “quotas?” Yeah, that’s gonna give the PO PO real credibility.

Funny. There are two things to say about that, though.

1. I don’t have a problem with policemen shooting fleeding felons.

2. Get women cops off the street, and there will be many fewer shootings.

We are headed towards war here at home

Baring a miracle or defeat without fighting back

The police will either peel off with us or become targets of opportunity to get the good arms and other insurgency needs

This is how it always evolves ask anyone who has lived it or seen it first hand

Your friendly local precient or sherfiffs office will become a reinforced federal bunker or an abandoned pillaged waste

Seems to me that maybe part of the reason that society is in such a mess is that cops stopped shooting criminals.

I agree with everything you said. It didnt deserve the death penalty. But that is why we categorise some acts as “stupid people who do dangerous stuff”. A note to the “not stupid”: Don’t cause a police chase and, once stupped, ram the police car with your car, risking the legs (and life) of a police officer. At that point you have used deadly force against another human being (who happens to hold a gun). And all that that implies...
