McMinn County (WBIR) - A Tennessee man was shot and killed by his wife last Saturday within 15 minutes of his release from jail. The man was arrested earlier in the day after police arrived on the scene at the Athens Super 8 Motel, responding to a report that Robert Vann Marshall, 34, was suicidal, armed and threatening to kill his wife and children.

Most likely, another justifiable homicide.

Basically, the wife has a restraining order. The husband shows up and the house, threatens to kill the wife and kids and gets arrested.

Husband makes bail - heads straight back to the wife's house, kicks the door in, and the wife shots and kills and him,

At about 1:38 p.m., 911 received a call from Melissa Marshall, claiming that her husband was attempting to get inside their home. With police on the way, she told dispatchers that Robert Marshall had forced his way inside and that she had shot him.

When seconds count, police are minutes away.

May I say that IF this had to happen... then it went well legally for her. She had him arrested, put in jail and he got out. Thus, the legal defense of protection against bodily harm is more substantial than a “she said and he is dead” type of defense. Think about it... the legal system couldn’t protect her and she was able to... what D.A. could bring charges against a woman that they couldn’t protect?
