Supreme Court's Souter has Locked History Away (Papers won't be released for 50 years)

For a historian, newly retired Supreme Court Justice David Souter seems exasperatingly shortsighted.

He didn’t want cameras filming the court’s public business during his 19 years on the nation’s highest tribunal.

Now, he doesn’t want scholars prying into his papers for 50 years.

Who’ll be around by then who knew him?

I am pretty sure that is the point

Souter does not want people that knew him commenting on his thinking and he does not want people who knew him harmed by what is in his papers.

If Souter was exemplary in his personal life and in how he conducted himself as a officer of the courts, who could be hurt by it?

So if we can restaff the house and senate in the upcoming election, why cant the congress simply repeal tons of this socialist agenda and get the country back on track? Isnt all this ultimately in the hands of the Congress? Why cant the Congress tell the Resident, Put up or pack up?

It’s my understanding that in order to repeal legislation, it would have to be repealed by both houses of Congress and also be signed by the President. If Obama vetoes the repeal, then Congress would have to have enough votes to override his veto. Things are looking good right now for Repubs to take back one or perhaps even both houses of Congress, but I think it’s highly unlikely that they would win enough votes to override a veto.

Isn't the same true of the JFK White House tapes?

We are approaching the date but the tapes may oxidize or "disappear" by then.

Not that I am any fan of Souter but no man that rises to the highest levels of political life is a saint, they all have written, said or done things that someone can use to tarnish their reputations.

The people that advise the Justices write to in the expectation that their correspondence will be kept in confidence. Once the Justice’s papers are opened to historians all of these letters will be publicly available. Justice Souter is try to respect the privacy of those who advised him in expectation of his discretion.

His sealing his papers for 50 years is not surprising or unusual. Most presidents have done it for at least some of their papers.
