This might mean that the cost of maintaining someone in prison is not worth the perceived benefit of punishing them for their activity. Everything in life is a tradeoff. You want more muscles you trade time doing something else for time spent in the gym. You want a fancy car, you trade spending less on something else, housing, food, entertainment, etc. Governments and legal systems make the same types of tradeoffs.
For the cost of keeping one person in a US federal prison would send a student through college for anywhere from one to four years. Depending on the prison and the school.

I was in Las Vegas years ago when a dude broke into a mortuary and had sex with a teen-aged corpse. He was arrested for breaking and entering - but not Necrophilia. Seems there was no law covering that as it hadn’t happened up to then (an arrest made)
