And POTUS 45 followed that up with this tweet a few minutes ago…
"I wish people would read or listen to my words on the Border Wall. This was in no way a concession. It was taking care of millions of people who were getting badly hurt by the Shutdown with the understanding that in 21 days, if no deal is done, it’s off to the races!"

It is a little used provision in law where one does pick a decent judge and files a petition asking if an act contemplated ( in this case, declare an emergency and shut border ànd build wall) is in keeping with written and case law. I think law is emergency.powers act
An affirmative statement by a judge would, I think, prevent the Dems from doing their usual trick of finding an activist judge to stop Trump once he began to exercise closure. The Dems would have to fight Trump legally, but he would be able to continue closure while they tried.
For heaven’s sake. It’s an EMERGENCY. President Trump diminishes that reality when he continues to threaten to treat it as such.

And Chuck and Nancy have said that they won't negotiate with President Trump. And still he opened the government without an EO for the part they've made loud and clear that they'll never negotiate for. The thought of closing the gov in three works is ludicrous. Not even the majority of Deplorables could support doing the crisis again, after he backed down already.

I’m very disappointed at how many FReepers are making disparaging comments on Trump’s decision as he is trying to get Congress to pass the proper legislation, instead of him exercising his legal authority to bypass them and order the national emergency that includes the barrier to be built.
Always so clear and simple for those not actually on the battlefield...let the President fight for us and back him - whining and moaning ain’t a battle plan....especially with him fighting a horde of evil armies at every step - if we can’t back him, we don’t deserve him.
If he doesn't support the Deplorable Agenda, he doesn't deserve us. His mistake in this was not insisting from evil Paul Ryan that the Republicans fund the wall and rein in the federal budget when they had the House majority.
President Trump needs a Deplorable intervention. The nation is going to slide into ruin real fast without President Trump defending the border! It can't wait, while Nancy and Chuck smugly brag about standing firm and Trump caving and them having to keep their base in line by deconstructing any border security that exists.
Let's define the problem. President Trump campaigned that he'd be different...when he made a decision, he'd do it! He caved on balancing that first budget and it including border security, he caved on infrastructure first, he caved when he said he'd get our (illegal) troops and intervention out of Syria, now he's decided to schedule an emergency!
Another posting on FR had an article that stated the Congress’ Research group had determined that POTUS had Constitutional and legislative authority to declare a National Emergency in this situation AND to direct the military to build the defensive barriers on the borders.
I don’t think any judge can win by trying to overturn that.

It seems that instead of playing the hero, Trump is trying to fix Congress and give them the glory. Truly a great man. I so misjudged him.
