Michael Flynn Did Not Violate The Logan Act

In December when Michael Flynn talked with Russian Ambassador Sergey Kislyak, Flynn said it was to discuss logistics of a call between President Donald Trump and Russian President Vladimir Putin. Apparently they also discussed the sanctions imposed by outgoing President Barack Obama on Russia for their assumed and alleged “hacking” of the U.S. election in November.

Many have attempted to claim that Flynn violated the Logan Act, since he was not yet functioning in his new appointment as the National Security Advisor. This is a red herring.

To follow the fakestream media, you wouldn’t know that Michael Flynn has not violated the Logan Act. The fakestream pundits were just throwing around some of the little muscle they have left.

Donaldus Magnus has chosen his opponents wisely. They teach him so much more about how to govern a country in four weeks than 40 years as a career politician in Washington could ever learn.

Donald J. Trump doesn’t KNOW “you can’t do things that way!” And so far, just about every one of the counterpunches has landed, with telling effect.

He wasn’t fired for talking to Russians, he was fired for lying about it. This is straight from President Trump’s own lips so should not be so difficult for FReepers to understand,

President Trump doesn’t cave to pressure to fire anyone. In fact, he does the opposite. Read his books and you will see he is a tough guy to work for. You can’t always know if someone is going to work well for you until they do. If Trump wanted him, he would still be there.

It should be obvious to all but libs/progressives that unless Flynn attempted to conduct negotiations with the Russian(s), he in no way violated the Logan Act. If he said that the Trump administration would be considering the sanctions against Russia (as has been reported), that did not constitute negotiations. Flynn did make a grievous error by not telling VP Pence the total truth. I think he was fearful of press reaction to his contact, not so much President Trump’s, and rightfully so.

Flynn lied to Pence and almost hung Pence in media lynching.

Flynn should not have lied to Pence. Flynn could have created plausible deniability which is a common practice in the military, in civilian government and corporate bureaucracies, and in our entire society.

That would be awkward, since he’s already appointed Lt. General Keith Kellogg to that position.

Well they cannot officially bring Flynn back but it’s obvious Trump knows Flynn was a valuable asset who was the victim of a political assassination. He may yet live “in the weeds”. It also revealed more of the leak problem and now is the time take a chain saw to the problem.

the Logan Act aspect of this was always very weird to me. a 1799 statute that has never been used to prosecute anyone in history is not really a credible threat.

On the other hand it looks like Flynn very likely perjured himself when he talked to the FBI and that’s 5 years unless he rolls and says who sent him to talk to the Russians about sanctions.

Good point. Now, if everyone in the Administration that goes on the Sunday "gotcha-fests" has/had this talking point ready, that would be a big help.

He should not have lied (if he indeed did) but if so I think it was because he was afraid his Russian contact would be mischaracterized. But if he lied he only made it worse for himself.

The more important question is did the Hillary campaign violate the Logan Act. At least Flynn was a member of a transition team of a duly elected administration, whereas, Hillary's campaign was not .
