An Alabama man who planted flowers on the gravesite of his fiancee and was arrested at the direction of the woman’s disapproving father was found guilty of littering this week.
About a month after Winston “Winchester” Hagans got engaged, his fiancee, Hannah Ford, was killed in a three-car crash in January 2021 that shattered what was supposed to be the happiest time of their lives. To honor the 27-year-old, Hagans placed a planter box full of fresh flowers and photos of the two of them on her grave in Auburn, Ala.
But earlier this year, Hagans was arrested on a charge of criminal littering. City officials had reassured him that he could put the planter at Ford’s gravesite unless there was a complaint. Then he discovered that a complaint had been filed — by the Rev. Tom Ford, his fiancee’s father.
“The police don’t enforce the law unless the owner of the plot tries to do something about it,” Hagans told The Washington Post earlier this year, adding that his late fiancee’s father did not approve of their relationship.
Hagans was convicted Thursday on one count of criminal littering and ordered to pay about $300 in fines and court costs, the Opelika-Auburn News reported. The 32-year-old man was also given a suspended jail sentence of 30 days that will remain suspended as long as Hagans does not place any more flowers or planter boxes on his fiancee’s grave.

“Dead flowers.”
Well, when you’re sitting there in your silk upholstered chair
Talking to some rich folk that you know
I hope you won’t see me in my ragged company
Cause you know I could never be alone
Take me down little Susie take me down
Cause I know you think you’re the Queen of the Underground
You can send me dead flowers every morning
Send me dead flowers by the mail
Send me dead flowers to my wedding
And I won’t forget to put roses on your grave

That Rev right there is a real dipstick who seems to have zero compassion? How anyone could sit and listen to this dipstick preach makes one scratch one’s head!
Bit of an over reaction there!
From #137:
“You’ve got a deed that says ‘no boxes.’ You’ve got a gentleman who’s been told ‘no boxes’ by a city lawyer in uncontroverted testimony. You’ve got a gentleman who says – and this is frankly where I lose my patience – ‘I don’t care what the rules are and what the law says, I’m going to do what I want.’ Well, he’s not. It’s a clear case of a violation of this deed, and a violation of the littering statute.”
“The fiancee’s father owns the grave.”
Ah he’s an a$$#.!3.
Even if that is so, it is not saying anything disrespectful about the owner of this website. I have nothing but admiration for Jim and I hope he gets well soon.
Also, are you originally from Texas? Clearly you are from East Texas because that's where you might find Gators. You certainly wouldn't find them in West Texas.
I've known some Texans in my life, and they didn't seem sensitive about cussing. Maybe Texans are softer from the East side than the West side? :)
That’s a good question. The owner of the graveyard might have something to say about it too. You can’t just put “anything” on a site, even if you own the site.
I’m quite touchy about something done here in central Kentucky that I never saw in Washington state. To wit, putting a memorial on the side of the road where someone died. Some of these are amazingly ornate. Further, we’ve lived here for 11 years and many of them are the same ones that were up when we moved here.
I think they are inappropriate. That is what gravesites are for. But I’d compromise with a “six month memorial” rule, eventually reduced to 90 days, and eventually not at all. It’s a good thing they don’t put one up for every person that dies in a hospital. There would be no room for beds. It would also be kinda creepy.
Or he could just ignore it till he quits one day
Some trauma folks like to keep polished so you don’t forget ever how much it hurt
You don’t want to forget it but u fear you will which brings guilt
Most things pass they just do in time the brain self protects over time
One doesn’t ever
Loss of a child
Especially violent and sudden of an innocent young child
Uvalde parents will never get over it
That’s is as bad as the killing
The killer
The cowards
Satan
All had a hand in creating pain for those families to live with at high volume forever
It ain’t like mom or dad dying
But you’re not from there
“I should not be surprised if we went to *that* cemetery and found the exact same stuff on one or more of the graves in it.”
Photo of cemetery doesn’t show any.
“If it’s the tacky display, then cemeteries all over the country are guilty of allowing that stuff to stay.”
None that I have ever seen.
We are a nation of laws, not feelings. The grave site if the property of the father. The dirtbag was told to not put that type of display on someone else’s PROPERTY 10 times. They decided the private property rights of others don’t mean anything, they cpould do what evee they pleased. This is the same attitude of the BLM protestors. They claim to have strong “feelings” of social injustice and think those “feelings” trump private property rights. Activist judges “feel” that this is right and so IGNORE the black letter law when making rulings.
The father problem saw this type of BAD CHARACTER in the the guy and that’s why he would be bad news for his daughter. I would be furious if some dirtbag kept pictures of himself and my daughters on her grave site. The guy is free to build a HUGE shine of his choosing on HIS OWN PROPERTY.
“Even if that is so, it is not saying anything disrespectful about the owner of this website.”
Your words are your actions.
You supported the dead guy on that gator
I’m surprised
I thought it was a hasty shoot too
Have you seen pictures of these flowers? I have on several different sites. I admit some flowers looked like they were planted. They were nearly black. Not my choice of color but no one asked me. I saw one picture of a box with flowers in it that looked nice. I think there is more to this story than we are being told.
Even if it is a city cemetery, those few square feet of ground belong to the family who bought it.
The owner in question here, Mr Ford, may be experiencing a wooden protrusion from between his back pockets, but it is his land.
That family has a book of things to resolve.
I don't see a headstone in this image.
“I’m paid to rule on the law and the facts.
So I would like to hear the "facts" that makes that display into "liter" in a cemetery that probably has many equally tacky displays as that one.
“Even if that is so, “
You would consider violation of rules you agreed to to NOT be disrespectful?
“So I would like to hear the “facts” that makes that display into “liter” in a cemetery that probably has many equally tacky displays as that one.”
None others in the photo!
I’m native Mississippian family there since 1790s
Alabama Mississippi and Arkansas always take hit from snobs
Especially if there are racial points at stake
The only Yankee state that takes hits is New Jersey
People are sheep usually
Aping common narratives incurious
Are you familiar with the incident in question, or have I mistaken you for someone else? My recollection is that someone with "Texas" something as a name, was quite happy about the man being gunned down in cold blood.
If it wasn't you, then I apologize for remembering wrong. Do you know of the incident of which I speak?
