Vanity: What happens if a candidate dies before the election.

Does anyone know what the legal process becomes if, after a Presidential candidate gets the nomination of a Party but before the General Election, that candidate dies or becomes totally incapacitated?

I bring to mind when the Missouri Senator Mel Carnahan died in a plane crash and was elected anyway, with his widow being appointed. Does the Party just get to substitute in whomever they want?

With Bernie having heart issues and Joe slipping deeper into dementia (or back in 2016, with HRC passing out regularly), is there any established law or procedure to handle this sort of thing?

Parties are private organizations they have no constitutional standing. Eventhough we’ve been conditioned by habit to think they do. They can pick or replace a candidate by any means their membership will tolerate & they think they can “sell” to the general voting public.

Probably depends on ballot access laws. Usually any question is resolved in Leftists favor.

It depends on the timing.

Prior to the parties convention. Most likely a brokered convention because nobody would have the votes outright. In the ABB scenario (anybody but Bernie), I could see them reaching out to someone like Bloomberg and putting AOC or Warren in as VP. Hilarity ensues. I would NOT see them reaching out to someone who did not even mount a campaign like Moochelle or the witch.

If it is post-party convention, but prior to the election, then it is still the parties choice. Keep in mind, there will be a VP also on the ticket, so the natural choice would be to elevate the VP to the head of the ticket and choose another VP, but when has logic ever played a part in politics.

If the candidate wins the election, but the electoral college has not selected yet, then it could be interesting. Whatever happens would probably fail on the first ballot, and then the opposite party candidate could actually look more attractive. Imagine a Biden/Warren ticket then Biden croaks prior to the EC. She is far enough moonbat that a lot of Electors could punt and say Trump is not so bad after all. I dont think they could substitute anyone OTHER than the VP for the President, but I could be wrong.

After electoral college votes but before sworn in. VP would be elevated as if it happened after swearing in. No, you cannot substitute their spouse. Once EC votes, succession must be someone they voted for. The only reason we have seen those games in other elections is because it was not a running mate scenario, and those fell into the state appointment scenario where the governor made that decision.

After swearing in, Constitutional line of succession.

If I remember correctly this has come up before on FR. In case of the dims, if the candidate gets arknicided after the convention, the DNC selects the candidate.
