He could squint really hard, and after about 30 seconds , tell that the BB gun had a smaller bore size than a real pistol. Of course, if it’s a real pistol....
Sounds like the homeowner didn't "mistake" the gun for a firearm -- it was a firearm. The definition of a firearm in the U.S. Code includes "any type of weapon . . . by whatever name known which will . . . expel a projectile by the action of an explosive or other propellant, and which has any barrel with a bore of more than one-half inch in diameter."

These teens probably thought their skin color would protect from them from any consequences of their actions.

Bullies show up to scare the kid into thinking his life is in danger. His father responds by shooting an attacker.
“But wait, it is just paint ball guns!”
You show up at my house in the middle of the night shooting it with what looks like guns while threatening my child ... I am in reasonable fear for my life, and I can kill you all in self defense.

Actions have consequences. The parents failed these children. They should have taught them respect for other people and their property. Jail the parents!

Too bad it was just one. Killing all of them would have been appropriate in this case.
Probably have to move after that though. No doubt the parents/brothers/sisters/cousins/etc would get revenge if they can. Still might.
You put a glass marble in a paintball gun and it can kill.
This is very similar to an altercation in Jacksonville FL 20+ years ago. A carload of teens were riding around shooting at picture windows with slingshots. An off duty navy chief thought the bang and the broken glass was from a gun and responded in kind. One of the teens was killed as the homeowner ran out to the street and fired shots at the car which was fleeing the scene. The court acquitted the homeowner. But his career was over at that point.

The car was most likely being used by the other shooters to drive away.
