FEMA to test ‘Presidential Alert’ system next week

Experts expressed little concern that the wireless emergency alerts could be used for political purposes.

President Donald Trump may soon be communicating with you directly on your phone — even if you don’t follow him on Twitter.

Next Thursday, the Federal Emergency Management Agency will do its first test of a system that allows the president to send a message to most U.S. cellphones.

More than 100 mobile carriers, including all the major wireless firms, are participating in the roll out, FEMA stated in a message on its website posted Thursday.

“The EAS [Emergency Alert System] is a national public warning system that provides the President with the communications capability to address the nation during a national emergency,” FEMA said.

The test message will have a header that reads “Presidential Alert,” according to the agency.

Users whose phones are on will twice hear a tone and vibration and then see an English-only (for now) message: “THIS IS A TEST of the National Wireless Emergency Alert System. No action is needed.”

The wireless emergency alerts (WEA) system was authorized by Congress in 2015 under a law that states the “system shall not be used to transmit a message that does not relate to a natural disaster, act of terrorism, or other man-made disaster or threat to public safety.”

Experts didn’t appear to be too concerned that Trump, known to use his smartphone to blast opponents, berate subordinates and take shots at the news media on Twitter, could abuse WEA.

I looked at it. Says nothing about the 6th ammendment. You know, the one that prevents prosecuting anyone (Huber) for a crime outside your jurisdiction, or modifying a jurisdiction to cover a previous crime. "In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law..."

That guidance will take into account, with appropriate consideration of military requirements, the principles contained in official guidance of the Attorney General to attorneys for the Federal Government with respect to the disposition of Federal criminal cases

That says that when the military handles charges under the UCMJ, they will take into account principles that apply to DOJ prosecutors in criminal cases handled by civil authorities. It does not mean, in any way, shape or form, that the DOJ will be involved in handling military tribunals, as so many here seem to think.

Some claim Huber will be involved in those military tribunals. That is not the way it works. He may coordinate with the military to determine who will prosecute, but he will not handle tribunals and the military will not handle prosecutions in federal court, at least until the appeals process, or whenever federal judges have jurisdiction to review military cases. There would be a statute that spells that out.

US citizens who are deemed enemy combatants are subject to military tribunals, that has never been in doubt. There is an unusual amount of confusion about the DOJ's role in tribunals and whether US Attorneys would be involved. They are from two wholly different systems.
