MINNEAPOLIS — The fatal shooting of an Australian woman by a Minneapolis police officer responding to her 911 call “should not have happened,” police Chief Janee Harteau said Thursday, adding that the officer’s actions “go against who we are in the department.”
In her first public remarks since the death of Justine Damond, a 40-year-old life coach and bride-to-be, Harteau defended Officer Mohamed Noor’s training but criticized his actions.
“The actions in question go against who we are in the department, how we train and the expectations we have for our officers,” Harteau said. “These were the actions and judgment of one individual.”

Bone, this is not going to get true billed for murder 2nd unless there is other inculpatory evidence introduced that we are not privy to. Such as the oft mentioned presumptive terrorist in disguise or hate of women based on his religious background, all presumptive, not based in known fact and frankly, scurrilous at this point. It debases anyone suggesting this as the motivations of Noor, regardless of his muslim background.
It is automatically assumed that he was acting in the scope of his duties until proven otherwise and even if true-billed, it would behoove them include manslaughter as an offense.
The malice of forethought can be almost instantaneous argument, is in my experience, rarely used as the prevailing evidence on which to hinge a case but rather other aggravating circumstances that bolster the state’s contentions. To suggest that Noor had some instantaneous rage against the decedent and then acted upon that rage is weak. If we look at the complaints that he had, he certainly had more provocation in those instances but did not kill them.
A defense attorney only need to cross his partner and the department training officer on whether they teach their officers to “kill”, which they will deny, and will be confirmed in their training curricula and policy. They answer will be that they are trained to “stop” the threat or perceived threat and then are mandated (Constitutionally) to provide first aid, further throwing doubt on the jury’s decision on whether a murder was conducted.
There is a plethora of officers who are beating 2nd degree murder handily, either by overcharging deliberately by the prosecution due to inexperience or simply to toss the case.
I contend that based on that historical evidence, this will be no different.
If indicted, and brought to trial, he may take a page from the Freddie Gray playbook and request a bench trial, which was very successful.

Well... to say again and even amplify something I said earlier, I knew a pastor in Minneapolis decades ago — a Lutheran with a heart for worldwide evangelism, one that the Lord even moved me to help in some of his projects till we finally ran into trouble that moved him to change careers to being a church pastor — and he told me he already smelled something spiritually rotten in the winds there. Something associated with Indian burial grounds and the “gay” part of town.
I might even know those devils, in an oppositional sense. Took many long years to build up enough strength in Jesus to buck them off of me.
But I’m goin’ to America now loaded for spiritual bear. Please DO pray for me folks... I mean business. Pray that the devil doesn’t trip up me or my buddy in evangelism (a different fellow now).

“Legalities” and what is obvious to a layperson may quite differ. Not any Joe Blow has gotten to speak up in a court, at least in the status quo ante.
The way you hide in quibbles and legalisms is more telling than anything else. I warn you: get ready to watch that shield fail.
Never shot a dog, and don’t intend to. Love ‘em and carry treats for them in my beat.
But there is no current training that I can think of that can train some officers not to be afraid of a dog. That baggage they bring with them.
I wish there was technology that officers had to mitigate these incidents, but when a pit bull is charging you, as has happened with some of my colleagues, you are going to go with the tool that is most effective and the quickest to deploy.
I would like to see specific training introduced in the police academy in handling dogs, as there are simple methods to defuse encounters, like banging on the fence prior to entering a yard for a call for service to determine if a dog is present.
Who said he was the best? Even in the medical field, someone has to graduate last. And they did make a big to do about him being the first somali on the force.
Society has demanded diversity and the police departments are striving for that. However, after Ferguson, many of the best and brightest are not considering a career in law enforcement so we work with what we have to maintain basic police service.

If I got my gun out on a rape call, how is that malice? I would call that prudent police work...but not in the car.
I agree his was mishandling his gun. Not what I would do or have done, even on shots fired calls.
No law that I am aware of that states there is a minimum or maximum times you can shoot someone...

Consider the fact that Police have been being assassinated, even in their vehicles.
I think the likelyhood is some of them are getting spooked. That in conjunction with his cultural disdain for women is what likely led to the shooting.
This is how you start taking apart a nation. Encourage the police to hold the ‘people’ in low regard and encourage the ‘people’ to distrust the police.
This is the first leg of the path towards a Venezuelan type government.
But they don't, and they aren't his actions alone, no matter how you may try to spin this: he had three previous complaints, apparently without disciplinary action.
