Two Families Sue a Neighbor to Have Their Autistic Son Declared a Public Nuisance

The lawsuit—still in effect despite the family's move—says that in previous years the boy has hit a baby with his hand, has spat at neighbors in addition to trying to ride his bicycle into them, and has sat on a neighbor’s cat on numerous occasions.

In October a Santa Clara County Superior Court judge issued a preliminary injunction (an order in the early stages of a lawsuit) to ensure that the boy didn’t hit or assault anyone or their personal property in the neighborhood.

Neighbor Sue Alford, who did not file the suit, told Mercury News, “We all met with them and talked to them about their son, but they didn't see our point of view. We wanted the street to be a safe place for other children.”

Just because he's autistic or retarded does not mean he should be allowed to roam free and harm others.

There was a case some time ago of a similar autistic man who was annoyed with a child playing near him while he was talking on the phone. He kicked the child.

The child's father saw it and knocked him out. He needed that lesson for the last 10 years and finally got it.

Then the mother gets all enraged at the guy who hit her precious, spoiled monster.

Another matter is that many kids formerly classified as “retarded” are now “autistic”, because there is more money per kid for special education for THAT diagnostic.

They were called brats and sent to their dads and given ass-whippings.

Nowadays, dads get sent to jail for that, kids taken away, etc. because the Social Serpents know so much more than the parents. Yes, there are real cases of abuse, but spare the rod and spoil the child.

What a tragedy. In earlier and more enlightened times, the parents of autistic children could have sent the child to the state hospital to live and be cared for, given three hots and a cot and medication enough to prevent him from hurting others.

These days the parents have to take care of the child at home, and are trapped within systems that say that they are going to help, but don’t. There is little to no respite and not enough drugs because no one including doctors want to cross the MR MI rights crowd.

And of course there are plenty of people making money off of treating these poor souls during the day.

Sociopaths do not have a conscience. Autistics have impulsivity and often mental retardation.

Now, a whole bunch of disorders are classed as “Autism Spectrum Disorders” because the shrinks think they are related.

No, the 'experts' just needed a new horse to ride after ADD had been milked for all it was worth.

All through the country, the leftists are closing the institutions, because the developmentally disabled need to be “free.” Here in CA, they have just announced the closure of the last of the institutions, which protected the safety of both the residents and the community. The politicians have no clue about the needs of these folks. If the families can’t care for them, they are forced into “community care homes” at great expense to the taxpayers.

There was a story a couple of years ago about one of these homes where the “caretakers” decided to have some fun by forcing the residents to fight each other. They took cell phone video of the fights. The videos came to light, and the operator of the home responded to the issue by banning cell phones from the property!

The parents could be in denial. I know someone with a mentally ill son. She won’t admit how bad it is, refers to his behaviors as “quirks” even though at least 4 psychiatrists have agreed he has obsessive compulsive disorder and is bipolar. She sabotages his meds because she worries about side effects and the first instance he experiences anything like one she wants him off that medicine. The parents of the boy in the article could be contributing to the son’s problems.

Why is the lawsuit still going forward?

I'd like to think it's possible they want the message to stay alive - control your kid so he doesn't keep being an issue no matter where you go. Else, it's like so many of us do - push the problem on someone else and kick back because we aren't being actively hurt right now. That's the attitude that helps ensure that a Cruz or a trump will face massive opposition from many of the People because fixing things will cause personal pain and inconvenience to many...

That is horrific and inhumane.

My mother used to work at the Sonoma State Hospital, which cared for mentally retarded patients. On Saturdays, they used to show movies, to which employees could bring their families for only $1. Sure, we had to sit on folding chairs, but we got to see the latest movies! I remember some of the kids there were extremely disabled--there is no way a family could take care of them, and I doubt a group home would do very well, either. Some of the higher functioning kids could probably do okay in a group home. In fact, some of the residents actually lived in cottages on the hospital campus, and a bus would take them to jobs during the day. They were almost independent.

People love to dwell on the dark side of institutions--and there have been some really bad situations at institutions. The solution is to fix the problems, not throw helpless people out on the streets.

Being bi-polar is super hard to live with when supported let alone having to deal with it as a child. I pray the child gets the help needed. Sometimes parents have their own issues like thinking everyone is out to get ya.
