Who determines Presidential 'incapacitation'.

Who determines a presidents competency or otherwise ‘incapacity’. Could congress instigate a special form of impeachment not meant to remove from office, but force him for a psychiatric evaluation and drug testing? Then a real impeachment is an option for removal?

Wouldn’t that stick to his underwear and make him feel uncomfortable.

And there’s the fact that the legal and constitutional method, impeachment by the House and conviction in a Senate trial, for removing a president from office has never been successfully completed. One resignation and two acquittals were as far as it ever got.

There’s a medical team that can absolutely determine presidential incapacitation. This unit is co-chaired by Dr.s Smith & Wesson.

A casual reading of the 25th Amendment seems to indicate that any action to remove a President for inability has to originate in the Executive branch, with either the President or the Vice President.

Of course if Joe Biden got it into his head that this was the only way he could sit in the big chair....

The Twenty-fifth Amendment requires that the Vice President and a majority of Cabinet Secretaries (or other body approved by Congress) decide the President is incapacitated, that group sends a notification to the Speaker of the House and the President pro Temp of the Senate and the Vice President becomes acting President until the President’s incapacity passes.

Don’t hold your breath for Biden and a majority of the Cabinet Secretaries to declare Obama to be incapacitated. I also suggest the concept of Biden as acting President frightens me as much as Obama being President.

You do realize that FR is monitored by the Secret Service, right?

We realize you were making a joke, but those guys don’t have much of a sense of humor when someone jokes about Our Glorious Leader. It is not like when Bush was president and liberals could and did openly call for Bush to be killed.

That is correct.

The only Constitutional method for the Legislative branch to remove a President is impeachment by the House and conviction by the Senate.

incompetent is not incapacitated. The Constitution doesn’t seem to have a solution for incompetence.

Yep, but we are talking about the Secret Service. I figure with their sense of focus and all the bars and strip joints between them and me, I'd pretty low on their priority list.

The absolute LAST THING we need is for that POS to become a martyr.

Even if we initiate the counter-revolution to restore the Constitution back to the Law of the Land, we have to make sure that Obama doesn’t even suffer a broken fingernail, or we’ll never hear the end of it.
