I don't get it. Obama 'pardoning illegals' does nothing.

Everyone is predicting that Obama will 'grant Executive Amnesty' to illegal aliens before Labor Day.

Can anyone explain to me what law, clause or Constitutional article Obama can cite that permits him the power to do such a thing?

Anything. I'll settle for anything.

Pardons wouldn't work. All that would do is forgive the past crimes of being in the country illegally. One microsecond after the Pardon was issued, all the illegal immigrants would be committing a new crime, the ongoing crime of being here illegally.

Pardons cannot be granted for future crimes, so that won't work either.

Just what is this lawless creep going to cite that permits him the power to do this?

If he has no power to do it, the States and the Republican conservatives in congress can simply refuse to cooperate.

Yes! It is the deliberate skirting of Congress, along with the incendiary remarks about it. That is worse than any one particular executive order—the breakdown of law and the Constitution.

Effectively that is the situation now, and it is not amnesty. Their goal is to get them voting, particularly in a state like Texas.

LAZ,

IMO, he hasn’t issued any kind of “Amnesty” by Executive Order because he knows - or he’s been advised by his inner circle- that it would be found unconstitutional in the federal courts (assuming there are federal judges who follow the constitution, but that’s a subject for another post). IINM, such an action on Obama’s part would meet the same fate in the courts as Truman’s seizure of the steel companies in 1952. (Youngstown v. Sawyer).

All he can do is what he did two years ago with the “Deferred Action for Childhood Arrivals” (DACA); those approved under that program received employment authorization cards, and supposedly their deportation cases - if they were in deportation proceedings - would not be continued. This went along with an admonition from DHS that such “relief” was entirely at the government’s discretion and could disappear any time.

And with regard to deportation proceedings (”removal” is the current term), they are civil proceedings, rather than criminal (as strange as that sounds): a Presidential pardon would not have any effect. All Obama could do to stop people being ordered deported is to fire all (or most) of the Immigration Judges, who are part of the DOJ. That would bring the deportation system to a grinding halt.

The RATS put a big push on to get the pubbies to go along with immigration reform, preaching that they won't win anymore election. Bam has bragged of giving amnesty and reform by the stroke of the pen, again threatening pubbies. If Bam signs an amnesty it will backfire on the RATS. Guess here is BAM is bluffing.

Probably his hoped-for scenario.

I’m guessing black Americans are torn between loyalty to their president and annoyance at being taken for granted once again. The result? Paralysis.

Or it would be paralysis if the War Against Cops hasn’t distracted them from what’s really going to happen to them if there is amnesty.

apillar is right. Obama directs the INS and Justice Dept. and can write new rules for both agencies to follow. Any illegals under federal indictment could be released on order of Holder.

Plus, Obama follows no laws - he does what he wants, could give amnesty in any form he wants, and neither congressional body will touch him. In my opinion, he is a piranha dictator.

If congress doesn’t sign off on it, still not much we can do.

And that’s the Hobson choice being handed to us.

Congress probably won’t sign off on this and the lil people won’t get legal status for the other lil people.

what we need to do is begin delegitimize the myth that is Mexico.

I have had this thing rumbling around my head now for years and have argued this thing for years in what was at one a territory of “New Spain”, California.

California was largely ungovernable and unmanageable for the powerful government of Spain and was even more so after the country of Mexico became an independent state, operating as a complete sovereign beginning in 1821.

It can be argued they would have lost California as a territory no matter what.

They had defaulted on so many international obligations that eventually they fought was to be called “The Pastry War” which resulted in capitulation by Mexico and payment of $600,000 pesos to France.

At this point Mexico was really a bankrupt nation but, there was no real interest by any country to take over the place and responsibly manage the place.

California wasn’t getting much from being a mere territory of Mexico and eventually left Mexico in a short lived revolt and became the 31st state of the U.S. in 1850.

Now, 11 years later France was back again seeking payments on loans, which the Mexican Government publicly and intentionally defaulted on.

France, at the behest of other creditors Spain and Great Britain occupied Mexico for 6 years and then left.

Mexico has a always had a storied life of corruption and piss poor management that continues to this day.

the result is a country of 135 million people, who have an average annual income of a some $9,500 per year.

contrast that with Canada, a country of 35 million and an average per capita income of some $54,000.

Mexico has way more resources than Canada and yet Canada swamps their GDP with $1.8 trillion compared to Mexico’s $1.2 trillion.

A country that has 70% fewer inhabitants produces 40% more GDP?

Say it isn’t so.

Now, there is no such tbing as Mexican bllod

There are no Mexican archeological digs in the USA, because they don’t exist.

there is no early mexican art or literature in America.

There is no Mexican Language. The Spanish they speak was given to them by some white guys, with black hair and dark brown eyes from Spain.

It depends upon how the action could be framed and presented. If it is presented as Prosecutorial Discretion then it is an action negating the written law in a blanket form and would be inactive under another Administration’s ability to issue an Ex. Order that said it no longer existed.

If he frames it as a Pardon or such, then he is legislating with the Pardon power and the legislative power is reserved for Congress, not the Executive, and a Pardon that attempts to un-write a law will be subject for a challenge in the SC as it is an issue between the branches. Can one house of Congress bring such action without the other? Who knows.

Are you confused sir? Do you not realize that the great leader who has created prosperity beyond the dreams of mere mortals and singlehandedly solved the health care crisis cannot allow his miracle working to be hindered by legal considerations? He has seas to lower and Earthquakes to stop. He operates at a level which is beyond the understanding of those who are bound by court decisions. He is a lightworker, a demigod and all such stuff like dat dere. You don’t be knowin’ nuttin’ bout stuff like dat.

Why not have State laws against being in the State while being in the United States Illegally?

At least that would have the potential to keep the illegals from changing the voting demographics of the states which passed such laws. The States which provide sanctuary now are already Blue.

Oh, and hang onto the Electoral College, with all your might.

I sure as hell hope Judicial Watch, Larry Klayman, perhaps even Jonathan Turley are on top of this one. I do not understand how that can be constitutionally legal. I would think even the Dems would want to stop him tip at least November since this would be the kiss of death for them as well!

You know as well as I do...it’s because he has a phone and a pen (and a golf cart). He can do whatever he pleases. I just hope it doesn’t occur to him to deport all American born citizens.
