Bullshinto. He shoved a jerk away from his wife as half the people here would do.
The shooter was the coward. He didn’t wait and politely speak to the man instead of his wife. And he shot an unarmed man.
Didn’t you watch Gunsmoke when you were growing up?

bull. that’s not what the law says. The law says it’s about the victim determining if he’s in fear for his life. I would be in fear for my life if a thug came out of nowhere and violently shoved me.

it’s not about a guy on a chat board saying the victim had time to decipher if he was in peril or not.

The pause and side step are ambiguous, and legitimately cause the victim to think the attacking thug, who already escalated a non-violent, if unpleasant, confrontation to an act of violence which could have easily resulted in grave bodily harm, and conceivably death, might attack again. And the second attack by the violent thug would have likely been far worse than the first, as the angry, violent thug would have been further incensed by the brandishing of the weapon, and would have sought retribution.

That makes no difference after the shove. He was sitting on his butt. You can’t shoot because that shove could have killed someone had it gone differently.

Cracker jacks. Not a source for a CCW permit or a law degree.

you sure seem to know alot for not knowing anything. what makes you so certain the thug didn’t have a gun in his waistband??? perhaps that’s why the sheriff was so quick to say they’re not arresting drejka.

the more you talk the more you sound like a lefty sympathizer who has no desire for facts; just make ‘em up as you go to fit your agenda.

I’m reminded of the elderly white driver who bumped into a young black child who jumped out in front of him. The situation escalated quickly with the whole neighborhood rushing to the scene and beating the man to death.

There have been other incidents with the same theme. They generally go unreported with little to no follow ups as the incident is closed.

This reminds me of the idiot here in Houston from a few years ago who brought his gun onto his neighbor’s front porch to confront him about a loud party. When the neighbor argued with him, he told a 911 operator, “I’m standing my ground,” and shot and killed the neighbor.

He was convicted of murder by two separate Harris County juries (there was an appeal), and was sentenced to life in prison.

While I’m in favor of “stand your ground” laws, I am not at all in favor of the name “stand your ground.” There are too many morons who think the catchy name politicians give to a law is the law itself.

El wrongo sport. The victim doesn’t determine that. The standard is if a reasonable person would see it that way. He is about to meet 12 of these reasonable people. Not every “he woulda”, “he coulda”, “maybe he was gonna”, and “I was scared and pooped” excuse flies.

Yes. That was a horrible incident. I remember several similar incidents.

One stands out in my memory of a very elderly man who late one night took the wrong turn off an interstate. He ended up lost deep in the ghetto where a mob dragged him out his car, robbed him, and beat him to death for no particular reason other than that they could.

There’s a handicapped parking space in town, across the street from a park, and by the tennis courts. I once saw a woman sitting in her car, reading the paper. She had her handicapped placard and thought she could sit there doing whatever. I made a snide comment , just because her car was covered with left wing bumper stickers. Around here, being fat is the primary handicap.

Reasonably. That’s your operant word. The guy he shot was backing away, and had not armed himself. The guy he shot didn’t start the fight but merely came to the assistance of his wife.
And whether you like it or not, things happen fast. Deadly force that was ok 2 seconds ago is homicide 2 seconds later. Even if you are really mad, humiliated, angry.

You aren't reading all the words. There's "reasonably believes", "imminent", "death or great bodily harm", in there.

You didn’t read the post nor watch the video. The wife was never being threatened. It wasn’t until her Husband was in physical contact distance from the shooter when the wife left the car and both got into the shooters face for a moment. Wish there was audio because I can pretty well guess what was said, but I’m not taking into consideration what I think. Just looking at the video the temp was right and the only reason why the Husband was backing away is because the shooter was drawing or preparing to draw.

Do you know how often people die from hitting their heads on the ground? Google it.

Fact is in many states (and should be everywhere) you initiate force you are saying you are ready to gamble your life on it. This guy did and he lost.

The Johnson dude has already spent a good portion of his adult life in prison.

At the age of 19 he as sentenced to 7 years in prison for attempting to shake his 6 month old son to death because the kid was crying.

and I’m sure he reasonably believed he was facing imminent death or great bodily harm. are we now going to pretend on FR that blatant thug attacks don’t happen all over our country all the time where they blind side, sucker punch, kick when on the ground for no reason? do you all want to further pretend these vicious acts can’t kill people? the sheriff got it right and I bet the DA will too

It should be noted that once the shooter was on the ground, he was no longer able to retreat.
