I don't always agree with jury verdicts, but I always respect them, especially if I wasn't in the courtroom to hear all the testimony. The Founders put the right to trial by jury in the Constitution for a reason.

This article is all the proof I need to tell me I made the right decision when I decided Red State was a garbage news site. Normally I will not read anything at Red State but since I wanted justice for Kate I foolishly “went there”. Puke.

The jury was never told about his priors - any of it ... to them, he was just another innocent man being railroaded ...

It’s felony murder: defendant was committing a felony, and somebody died as a result.

Slam dunk case. Don’t complicate it.

I used to - however a jury of “peers” in this day and age, if comprised mostly of millennials, is very likely to be composed of publicly educated brainwashed atheistic Marxists. If those are my peers, then I never want to have to trust a modern day jury with deciding my fate.

Every child of normal intelligence over the age of 5 knows how a handgun works. The idea that this murdering SOB wouldn’t know what it was is more than ridiculous.

You’d have to believe so many fantasies not to go for murder! Guns go off by themselves! I was just shooting at seals! I found it in a t-shirt under a bench!

I have no doubt that the DA’s office messed up - perhaps, on purpose, to send a message to the president.

Color me cynical.

That is manslaughter, right there.

I agree the prosecution overcharged. However, the dangerous guns stats are rubbish. If it were dangerous, police and military wouldn’t use it.

This guy handled a weapon he did not know how to use. He pointed it in the general direction of people and caused it to discharge. That is manslaughter. I would vote yes on that 100% of the time and sleep like a baby.

You can see how defense counsel could easily argue that a homeless illegal immigrant would be unfamiliar with one.

It fires by pulling the trigger like virtually all guns made in the past 700+ years.

I live near Reno, and we get weeknight news at 10 PM that comes out of San Fran.

I clearly remember when this happened tht the pics of ‘the scene’ on the pier showed 3 (THREE) of those bright yellow markers that police use to mark where brass from cartridges lave landed in or near a crime scene.

This trial only talked about the gun firing once—accidently—but I remember the first coverage saying 3 shots were fired. That is NOT an accident. NOT ONCE-—THREE times......

A gun owner got incensed about the verdict & said he had 7 handguns. He would load all of them & rack a shell into each one’s chamber ready for firing. Then he would put them all on the floor or sidewalk & JUMP UP & DOWN ON THEM & PROVE that NONE of them would ‘go off accidently’ as described by the illegal who walked away from this MURDER.

This entire trial was a wholesale travesty. Sanctuary state at it’s finest. May Jerry Brown rot in Hell for his actions against California.

According to Judge Jeanine (a former judge and prosecutor), the SIG Sauer actually requires a heavier pull, making it much harder to fire.

To the progressives who run San Francisco, murder is OK if you’re an illegal alien and your victim is an American citizen — especially a white one.

This was a horrible verdict. Here in CA we followed the case on all the radio shows and we did learn that the evidence did not leave any room for 1st or 2nd degree murder. She was killed by a ricochet.

But you cannot tell me that a man playing with a loaded gun on a crowded tourist pier gets ACQUITTED for the death he caused.

A person yelling fire in a crowded theater gets more of a penalty.

I cannot agree without stipulation. All aspects of government can be abused, including trial by jury. When abused, they must be challenged! (Soviet Russia had trials too.)

The attorneys on both sides, the judge, the jury pool, all were firmly leftist by my estimation, producing the desired political outcome.

I opine that the prosecutor deliberately overreached in order to provide cover for the intended not guilty verdict.

I have witnessed too much from California generally, and San Francisco specifically, to accord any benefit of the doubt on motives and actions in such a landmark case held in such a communist enclave.

Why wasn’t he prosecuted for gun crimes?

Illegal possession and illegal discharge at least.

I have served on a criminal jury before. Not a murder case, but it was still difficult to do. We were nine people, who after 2.5 days, found the defendant not guilty.

I was the one of the last two to come around. We tried to “re-enact” the event in the jury room. I was eventually convinced he wasn’t guilty. The guy had a firearm and the gun went off. No one killed, but an assault charge was made. He claimed it went off accidentally. Had a public defender.

That being said, I don’t see how the guy wasn’t at least found guilty of involuntary manslaughter.

Prosecution has a high bar, but this one seemed more open and shut.

Hope the feds can do a better job.
